Ordinance 1979-03ORDINANC~ 79- 3 ORDINANCE OF THE CITY OF GtLROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY REZONING A 2.78 ACRE PARCEL BEHIND THE SOUTHEAST CORNER OF LEAVES (GENERAL INDUSTRIAL) DISTR DISTRICT. WHEREAS, application Z 78- %EY ROAD AND ~RRAY AVENUE FROM M2 [CT TO HC (HIGt{WAY COMMERCIAL) has heretofore been made by BURGER KING CORPORATION to the Planning Commission of the City of Gilroy for the rezoning of the premises hereinafter described from M2 to HC District; and WHEREAS, the Planning CommSssion of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, has approved a Negative D~claration under the California Environmental Quality Act, has determined that the rezoning will not have a signifi- cant adverse affect on the environment, and has made its report to the Council of the City of Gilroy, in which it recommends that the herein- after described premises be rezoned from M2 (General Industrial) District to HC (Highway Commercial) District; and WHEREAS, the Council of the City of Gilroy has fixed the 2nd day of January, 1979, at the hour of 8:00 o'clock p.m. in the Council Chambers in the City Hall at 7390 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon the said application, at the time and place fixed in the said notice before the COuncil, and the Council having duly considered the said application and the evidence presented, has approved the Negative Declaration under the California Environmental Quality Act, and has determined that the said Zoning Ordinance should be amended ORDINANCE NO. 79-3 in accordance with the report o NOW, THEREFORE, THE COUNCIl FOLLOWS: '~ :he said Planning Commission. )F THE CITY OF GILROY DOES ORDAIN AS Section ~: The Zoning Ordinance of the City of Gilroy is hereby amended by removing from M2 Distirict and placing in HC District, as the same are described and defi~ed in the Zoning Ordinance of the City of Gilroy, the following described premises: Ail that certain real property situated in the City of Gilroy, County of Santa Clara, State of California, described as fol%ows: That 2.78 acre parcel behind the southeast corner of Leavesley Road and Murray A~enue and identified as Santa Clara County AssessorI s Parcel No. 841-59-13. Section 2: The official map constituting a part of the Zoning Ordinance of the City of Gilroy shall be amended to reflect the fore- going changes of classification of the said property. Sectioq ~: All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4: This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval.
