ORDINANCE OF THE CITY O~ GILROY AMENDING THE ZONING
ORDINANCE OF SAID CITY ~Y PREZONING A 25 ACRE PARCEL
ADJOINING THE CITY OF GILROY ON TIlE SOUTH SIDE OF PACHECO
PASS HIGHWAY APPROXIMATELY 1,500 FEET EAST OF THE SOUTH
VALLEY FREEWAY AS HC (HIiGHWAY COMMERCIAL) AND M2 (GENERAL
INDUSTRIAL)
WHEREAS, CHARLES ACKER and RICHARD BERGHELLA have heretofore
filed with the Planning Commission of the City of Gilroy a petition in
due form requesting the prezaning of a 25 acre parcel as HC (Highway
Commercial) and M2 (General industrial) Districts; and
WHEREAS, the Planning Commission of the City of Gilroy has given
due notice of a public hearing upon the said application, in accordance
with the Zoning Ordinance of ithe City of Gilroy, has held the hearing,
has approved a Negative Declaration under the California Environmental
Quality Act, and has made its report to the Council of the City of
Gilroy, in which it recommendis that the 25 acre parcel hereinafter
described be prezoned as set iforth above; and
~HEREAS, the Council of ithe City of Gilroy has fixed the 5th day
of February, 1979, at the hour of 8:00 o'clock p.m. in the Council
Chambers in the City Hall at 17390 Rosanna Street, Gilroy, California,
as the time and place for hea~tng the said report and recommendation
upon the said application, anid notice of the said hearing has been
given in accordance with the isaid Zoning Ordinance, and a public hearing
has now been held upon the said application before the Council, and
the Council having duly considered the said application and the evidence
presented, has approved the N~gative Declaration under the California
Environmental Quality Act, and has determined that the said Zoning
Ordinance should be amended in accordance with the report of the said
Planning Commission,
NOW, THEREFORE, THE COUNCIL CF THE CITY OF GILROY DOES ORDAIN' AS
FOLLOWS:
Section 1: The Zoning Ordinance of the City of Gilroy is hereby

amended by prezoning to become effective upon annexation and placing
the most northeast 7.5 acre portion fronting on Pacheco Pass Highway
in an HC District and the sout!herly 17.5 acres, more or less, in an
M2 District, as the same are described and defined in the Zoning
Ordinance of the City of Gilro!y, the following described premises:
Ail that property loicated in the County of Santa
Clara, State of Calilfornia, described as follows:
Parcel A
To HC District, the most northeasterly 7.5 acres
of Santa Clara County Assessor's Parcel No.
841-17-29 east of t~e South Valley Freeway and
south of Pacheco Pasis Highway.
P~rcel B
To M2 District, thatiparcel South of and adjacent
to Parcel A and being the remaining portion of
San~a Clara County ASsessor's Parcel No. 841-17-29.
Section 2: The official map constituting a part of the Zoning
Ordinance of the City of Gilrok shall be amended to reflect the fore-
going changes of classification of the said property.
Section 3: All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
Section 4: This ordinanc~ shall take effect and be in full force
thirty (30) days from and after its passage and approval, and upon
annexation of said property toi the City of Gilroy.
