Ordinance 1979-08ORDINANCE NO. 79-8 ORDINANCE OF THE CITY OF !GILROYAMENDING iHE ZONING ORDINANCE OF SAID CITY BY REZO~ING A 0.7 ACRE PARCEL ON THE SOUTHEAST CORNER QF LEAVESLEY ROAD AND MURRAY AVENUE FROM M2 (GENERAL ~NDUSTRIAL) DISTRICT TO HC (HIGR57AY COMMERCIAL) DISTRICT. WHEREAS, application Z 781-29 has heretofore been made by the Planning Commission of the Cit rezoning of the premises herei and WHEREAS~ the Planning Com y of Gilroy on its own motion for the nafter described from M2 to HC District; mission of the City of Gilroy has given due notice of a public hearing ~pon the said application, in accordance with the Zoning Ordinance of thte City of Gilroy, has held the hearing, has approved a Negative Declaraltion under the California Environmental Quality Act, has determined thait the rezoning will not have a signifi- cant adverse affect on the environment, and has made its report to the Council of the City of Gilroy, lin which it recommends that the herein- after described premises be rezoned from M2 (General Industrial) District to HC (Highway Commercial) District; and WHEREAS, the Council of the City of Gilroy has fixed the 20th day of February, 1979, at the hour of 8:00 o'clock p.m. in the Council Chambers in the City Hall at 7390 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon the said application, at the time and place fixed in the said notice before the COuncil, and the Council having duly considered the said application and the evidence presented, has approved the Negative Delcaration under the California Environmental Quality Act, and has determined that the said Zoning Ordinance should be amended -1- ORDINANCE NO. 79-8 in accordance with the report !of the said Planning Commission. NOW, Tt~REFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: : Section 1: The Zoning Ordinance of the City of Gilroy is hereby amended by removing from M2 District and placing in HC District, as ~ fi. ~ the same are described and se lne~ in the Zoning Ordinance of the City of Gilroy, the following descriibed premises: Ail that certain real pr!operty situated in the City of Gilroy, County of Santa Clara, State of California, described as follows: That 0.7 acre parcel on the southeast corner of Leavesley Road and Murray Avenue and identified as Santa Clara County Assessor's Parcell No. 841'59-7. Section 2: The officiali map constituting a part of the Zoning Ordinance of the City of Gilroy shall be amended to reflect the fore- going changes of classification of the said property. Section 3: All ordinanc!es and parts of ordinances in conflict herewith are hereby repealed. Section 4: This ordinance shall take effect and be in full force thirty (30) days from and afte~ its passage and approval.
