7Y CODE PROHIBITING UNDERGROUND
iQUIDS IN RESIDENTIAL AREAS.
THE CITY COUNCIL OF THE CITy OF GILROY DOES ORDAIN'AS FOLLOWS:
SECTION I. Section 16.33 of the Gilroy City Code is enacted
to read as follows:
Sec. 16.33. Underground stgrage ~ flammable liquids.
Except on land owned bY a public agency for use by
publicly owned vehicles, it shall be unlawful for any
person to store flammable liquids underground in a
residential zone, or for any person to permit such liquids
to be stored underground on residential property he owns
or controls~
SECTION II. Ail other ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION III. This is an Emergency Ordinance which shall take
effect immediately upon its passage and,approval. The facts and
circumstances giving rise to the~!emergency are as follows:
The recent gas shortage has increased the potential for
the underground storage of dangerous liquids by private
parties in residential areaa, which is an immediate threat
to health, public safety and welfare of the general con,unity.
This Ordinance was introduced as an emergency measure and passed
and adopted to become effective immediately and ordered published by
title and summary in accordance With provisions of the City Charter
at a regular session of the City ~Council held on the 7th day of May,
1979, by the following vote:
