Ordinance 1979-10ORDINANCE NO. 79-10 ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY PREZONING A 14.82 ACRE PARCEL AND .~ 39.5 AC.RE PARCEL ON THE WEST SIDE OF THE CITY OF GILROY SEWER FARM SOUTH OF LUCHESSA LANE AS M2 (GENEi~A~L INDUSTRIAL) WHEREAS, the CITY OF GILROY has heretofore filed with the Planning Commission of the City of Gilroy petition Z79-4 in due form requesting the prezoning Of a 14.82 acre parcel and a 39.5 acre parcel as M2 (General Industrial) Districts; and WHEREAS, the Pla~Lning commission of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, has approved an Environmental Impact Report under the California Environmental Quali~y Act, has determined that the rezoning will not have a significant adUerse effect on the environment and has made its report re, the Council of the City of Gilroy, in which it recommends that ~;he 25 acre parcel hereinafter described be prezoned as set forth above; and WHEREAS, the Council of the City of Gilroy has fixed the 7th day of May, 1979, au the hour ~f 8:00 o'clock p.m. in the Council Chambers in the City }[all at 73i90 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and reco~endation upon the said application, and notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon !the said application before the Council, and the Council having duly considered the said application and the evidence presented, has approved the Environmental Impact Report under the CaLifornia Environmental Quality Act, has determined that the rezoning w~.ll not have: a significant adverse effect on the environment and has determined that the said Zoning Ordinance ORDINANCE 110. 79 10 should be amended in accordance with the report of the said Planning Commi s s ion, NOW, ~{EREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: Section 1: The Zoning Ordnance of the City of G~lroy is hereby amended by prezoning to become/effective upon annexatzon and placing in an M2 District, as the same Ordinance of the City of Gilroy Ail that property loc Clara, State of Calif is described and defined in the Zoning , i~he following described premises: ated in the County of Santa om~ia, described as follows: A 14.82 acre parcel and a 39.5 acre parcel on the west boundary of the ]iiroy sewer farm south of Luchessa Lane, being [)0rtions of Santa Clara County assessors parcels 841~I5-003 and 841-30-005, legal descrzptions and a mapiof which are attached as Exhibits to Planning C~ission Resolution #79-19. Section 2: The official map constituting a part of the Zoning Ordinance of the City of Gilroy going changes of classification Section 3: Ail ordinances herewith are hereby repealed.
