Ordinance 1979-11ORDINA ORDINANCE OF THE CITY OF ORDINANCE OF SAID CITY BI NCE NO. 79-11 GILROYAMENDING THE ZONING PREZONING A 1.7 ACRE PARCEL ADJOINING THE CITY OF GIIROY ON THE SOUTHWEST CORNER OF RENZ LANE AND NINTtt STREET EAST OF THE SOUTH VALLEY FREEWAY AS M2 (GENERAL INDUSTRIAL) DISTRICT. WHER~EAS, THOMAS A. LAP, KIN! has heretofore filed with the Planning Commission of the City of Gilroy petition Z 79-5 in due form requesting the prezoning of a 1.7 acre parcel as M2 (General Industrial) District; and ~ WI~REAS, .the Planning Commission of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, has approved a Negative Declaration under the California Environmental Quality Act, and has made its report to the Council of the City of Gilroy, in which it recommends that the 1.7 acre parcel hereinafter described be prezoned as set forth above; and WHEREAS, the Council of the City of Gilroy has fixed the 21st day of' May, 1979, at the hour of 8~00 o'clock p.m. in the Council Chambers in the City Hall at 7390 Rosanna Street, Giiroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon the said application before the Council, and the Council having duly considered the said application and the evidence presented, has approved the Negative Declaration under the California Enviror~ental Quality Act, and has determined that the said Zoning Ordinance should be amended in accordance with the report of thet said Planning Commission, NOW, THEREFORE, TItE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS -1- ORDINANCE NO. 79-11 FOLLOWS: Section 1: The Zoning Ordinance of the City of Gilroy is hereby amended by prezoning to becomeieffective upon annexation and placing in an M2 District, as the sameiis described and defined in the Zoning Ordinance of the City of Gilroy, the following described premises: All that property located in the County of Santa Clara, State of California, described as follows: That 1.7 acre parceliat the southwest corner of Renz Lane and Ninth Street, being Santa Clara County Assessor's Parcel No~ 841-16-42. Sectio~ ~: The official map constituting a part of the Zoning Ordinance of the City of GilroY shall be amended to reflect the fore- going changes of ciassificatio~ of the said property. Section 3: Ail ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4: This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval, and upon annexation of said property to =the City of Gilroy.
