Ordinance 1979-13 0RDINAMCE NO. 79-13
AN ORDINANCE OF THE CITY OF! GILROY AMENDING SECTION
16.33 OF THE GILROY CITY CODE PROHIBITING UNDERGROUND
STORAGE OF FLAMMABLE LIQUIDS IN RESIDENTIAL AREAS.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
SECTION I. Section 16.33 oF the Gilroy City Code is amended
to read as follows:
~.ee. 16.33. Underground st'~rage o_~f flammable ~iqUids.
Except in tanks instal[ed prior to May 7, 1979, and
inspected, approved and licensed by the Fire Department,
and except on land owned by a public agency for use by
publicly owned vehicles, it shall be unlawful for any
person to store flammable liquids underground in a resi-
dential zone, or for any pe~son to permit such liquids to
be stored underground on re~identtal property he owns or
controls.
SECTION II. Ail other ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION III. This is an Emergency Ordinance which shall take
effect immediately upon its passage and approval. The facts and circum-
stances giving rise to the emergency are as follows:
The recent gas shortage has'increased the potential for
the underground storage of dangerous liquids by private
parties in residential areaS, which is an immediate threat
to health, public safety and welfare of the general
community. ~
This Ordinance was introduced as an emergency measure and passed
and adopted to become effective immediately and ordered published by
title and summary in accordance With provisions of the City Charter
at a regular session of the CityiCouncil held on the 4th day of June,
1979, by the following vote:
