Ordinance 1979-16 ORDINANCE NO. 79-16 ! ORDINANCE OF THE CITY OF ~ILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY|REZONING A 0.55 ACRE PARCEL EAST OF THE SOUTH VALLEY FREEWAY BETWEEN RENZ LANE AND TENTH STREET FRO~{ CI (NEIGHBORHOOD COMMERCIAL) DISTRICT TO M2 (GENERAL INDUSTRIAL) DISTRICT. WHEREAS, application Z 7979 has heretofore been filed by TREVIS BERRY and the DIAMOND ADVERTISING CO. with the Planning Co~ission of the City of Gilroy for the rez0ning of the premises hereinafter des- cribed from C1 to M2 District; ~and WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing!upon the said application, in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, has approved a Negative Declaration under the California Environmental Quality Act, has determined that the rezoning will not have a signifi- cant adverse affect on the environment, and has made its report to the Council of the City of Gilroy, ,in which it recommends that the herein- after described premises be rezoned from C1 (Neighborhood Commercial) District to M2 (General Industrial) District; and WHEREAS, the Council of t~e City of Gilroy has fixed the 2nd day of July, 1979, at the hour of 8i:00 o'clock p.m. in the Council Chambers in the City Hall at 73!90 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon the said application, at the time and place fixed in the said notice before the Council, and the Council having duly considered the said!application and the evidence presented, has approved the Negative Declaration under the California Environmental Quality Act, and has determined!that the said Zoning Ordinance should be amended in accordance with th~ NOW, THEREFORE, THE COUN~ FOLLOWS: report of the said Planning Commission. IL OF THE CITY OF GILROY DOES ORDAIN AS Section 1: The Zoning Ordinance of the City of Gilroy is hereby amended by removing from C1Diistrict and placing in M2 District, as the same are described and def%ned in the Zoning Ordinance of the City of Gilroy, the following described premises: All that certain real property situated in the City of Gilroy, County of Santa Clara, State of California, described as follows: That 0.55 acre parcel east of the South Valley Freeway between Renz Lane and Tenth Street and identified as Santa Clara County AssessOr's Parcel No. 841-17-26. Section 2: The official map constituting a part of the Zoning Ordinance of the City of GilroY shall be amended to reflect the fore- going changes of classification of the said property. Section 3: Ail ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4: This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval.
