AN ORDIN~qCE OF THE CITY OF GILROY ENACTING SECTION
16.34 OF THE GILROY CITY CODE PROHIBITING DESCRIBED
BURGLAR ALARM SYSTEM VIOLATIONS.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
SECTION I. Section 16.34iof the Gilroy City Code is enacted
to read as follows:
S~c.. 16.34 Burglar alarm ~ystems - violations
It shall be unlawful for any person to own, operate, install
or maintain any mechanical or electrical device for the detection
of unauthorized entry which: ~
(a) Is knowingly activated by the owner, operator, his agents
or employees when no burglary Or robbery is in progress.
(b) Is activated more than three times within a twelve month
period from negligence, mechaniical or electrical failure or any
cause or causes other than unauthorized entry. Each such "false
alarm" after the third such "f!alse alarm" within any twelve months
shall constitute a separate o~fense.
(c) Emits a sound similari to that of an emergency vehicle
siren or a civil defense warning system.
(d) Does not shut off automatically within fifteen minutes
after activation.
(e) Is not registered with the police department in accordance
with regulations established by Council resolution.
SECTION II. Ail other ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION III. This ordinance shall take effect and be in full
force thirty (30) days from and after its adoption and approval.
