Ordinance 1979-24ORDINANCE NO. 79-24 AN ORDINANCE OF THE CITY OF GILROY ENACTING SECTION 57 OF THE ZONING ORDINANCE REGULATING STORAGE OF RECREATIONAL VEHICLES AND TRAILERS. WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing Upon the proposed enactment in accord- ance with the Zoning Ordinance of the City of Gilroy, has held the hearing, and has made its report to the Council of the City of Gilroy, in which it recoxmends that section 57 of the Zoning Ordinance be enacted as specified herein, and WHEREAS, the Council of the City of Gilroy fixed the 20th day of August, 1979, at the hour of i8:00 p.m. in the Council Chambers in the City Hall at 7390 Rosanna Street, Gilroy, California, as the proposed enactment, and due notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon the said application, at the time and place fixed in the said notice, before the Council, and the Council having duly considered the proposed enactment and the evidence presented, and has determined that section 57 of the Zoning Ordinance should be enacted in accordance with the report o~ the said Planning Commission, NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: Section 1: Section 57 of ~he Zoning Ordinance is hereby enacted to read as follows: Sec. 57. tLECREATIONAL VEHICLE AND TRAILER STORAGE 57.1. Definitions. For the purpose of this Section, the following definitions are hereby adopted- RECREATIONAL VEHICLE means !a vehicular unit not exceeding 40 feet in overall length. 8 feet in width, or 12 feet in over- all height, primarily designated as temporary living quarters 79-24 for recreational, camping or travel use; it either has its own motive power or isidesigned to be mounted on or drawn by an automotive vehi[cle. Recreational vehicle includes motor home, truck camper over 7" in height, travel trailer, and camping trailer, but not vans or trucks with campers less than 7' in height. TRAILER means a vehicle without motive power not exceeding 40 feet in body length, 8 feet in width, or 12 feet in overall height, including a boat mounted on the trailer, designed so that it can be drawn by motor vehicle, to be used for the carrying of boats, persons, cargo or animals. 57.2. Storage, all zones. In all zones, it is permissible to park an operable recreational vehicle or trailer, for storage in the following manner: (a) Parking is permitted inside any enclosed structure, which structure otherwise conforms to the zoning requirements of the particular zone, where located; Parking is permitted outside in the side yard or rear yard, provided it is not nearer than two feet to the lot line; (c) Parking is permitted only for storage purposes, and any recreational Vehicle or trailer shall not be: (1) Used for dwelling purposes. (2) Permanently connected to sewer lines, water lines, or electricity. The recreational vehicle may be connected to electricity temporarily for charging batteries and other purposes. (3) Used for storage of goods, materials, or equipment other than those items considered to be part of the unit or essential for its immediate use. A recreational vehicle may be parked temporarily anywhere on the premises during active loading or unloading; and the use of electricity or propane fuel is permitted!when necessary to prepare a recreational vehicle for use. 57.3. ResidentJ. al zones. In all residential zones, the recreational vehicle shall be owned by the resident on whose property the unit is parked for storage, i 57.4. R-1 zomes in R-1 zones, parking is permitted outside a structure in the front yard on a paved driveway, provided all of the f°ilowing conditions exist: -2- O~'.D INANCE Nil.) 79-24 (1) (2) (3) Space is not avail yard, or there is the side yard or deemed to have ~ [able in the rear yard or side no reasonable access to either ~ear yard; a corner lot is always reasonable access; Inside parking is~not possible; The unit is parked perpendicular to the front curb; (4) <5) No part of the unit may extend over the public sidewalk or public thoroughfare (right-of-way); No more than one (1) Recreational vehicle or trailer shall be allowed in the front yard of each residential unit; and (6) The unit must be parked at least 5' from side property lines. Section 2: All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 3: This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval.
