Ordinance 1979-29ORDINANCE NO. 79-29 ORDINANCE OF THE CITY OF GILROY A}~NDING THE ZONING ORDINANCE OF SAID cITY BY REZONING A 0.555 ACRE PARCEL ON THE NOR~{ SIDE OF WELBURN AVENUE 65 FEET EAST OF CHURCH STREET FROM M2 (GENERAL INDUSTRIAL) DISTRICT TO CM (COMMERCIAL INDUSTRIAL) DISTRICT. WHEREAS, application iZ 79-15 has heretofore been made by LARRY ESSARY CONSTRUCTION, !INC., to the Planning Commission of the City of Gilroy for the ~rezoning of the premises herein- after described from M2 to CMiDistrict; and WHEREAS, the Plannin~ Commission of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zoning iOrdinance of the City of Gilroy, has held the hearing, has approved a Negative Declaration under the California Environmental Quality Act, has determined that the rezoning will not have a significant adverse affect on the environ- ment, and has made its report ito the Council of the City of Gilroy, in which it recommends that the hereinafter described premises be rezoned from M2 (General Industrial) District to CM (Co~ercial Industrial) District; and WHEREAS, the Council iof the City of Gilroy has fixed the 19th day of November, 1979, a~ the hour of 8:00 o'clock p.m. in the Council Chambers in the City Hall at 7390 Rosann~ Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public Nearing has now been held upon the said application, at the ~ime and place fixed in the said notice before the Council, and the Council having duly considered the said application and the evidence presented, has approved the Negative Declaration unde~ the California Environmental Quality Act, and has determined that ~he said Zoning Ordinance should be ORDINANCE NO. 79-29 -1- amended in accordance with the Commission. NOW, THEREFORE, THE C~ ORDAIN AS FOLLOWS: Section 1: The Zoninl is hereby amended by removing report of the said Planning )UNCIL OF ~tE CITY OF GILROY DOES Ordinance of the City of Gilroy rom M2 District and placing in CM District, as the same are d~scribed and defined in the Zoning Ordinance of the City of Gilroy, the following described premises: Ail that certain real property situated in the City of Gilroy, County o~ Santa Clara, State of CalifoSnia, described as follows: That 0.555 acre parcel on the north side of Welburn Avenue 65 feet east of Church Street and identified as Santa Clara County Assessor's Parcel No. 790-27-19 and 31. Section 2: The official map constituting a part of the Zoning Ordinance of the City of Gilroy shall be amended to reflect the foregoing changes of classification of the said property. Section 3: Ail ordinances and parts of ordinances in conflict herewith are hereby rePealed. Section 4: This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval.
