Ordinance 1980-02 ORDINANCE NO. 80-2
AN ORDINANCE OF THE CITY ~F GILROY AMENDING SECTION 18.6
OF THE GILROY CITY CODE CONTROL'LING INTOXICATING LIQUOR
IN PARKS.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
SECTION I.
read as follows:
Section 18.6 9f the Gilroy City Code is amended to
Sec. 18.6 Intoxicating L~quor.
(a) No person shall consume intoxicating liquor, as
defined in Section 16.28, or have in his or her possession
or control an open container of an intoxicating liquor, in any
-city park except in estab%ished picnic areas at Christmas
Hill, Las Antmas, and SaniYsidro Parks. As used in this
section, "established picnic area" means any per~.anent picnic
area improved with tables !and barbecue pits and zdentified by
appropriate signs.
(b) The Director may on a one time basis modify or waive
the requirements of this Section by special Facility Use
Permit.
(c) A person being Convicted pursuant to this section,
shall be deemed guilty ofla misdemeanor.
SECTION I. All other ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION III. This ordinance shall take effect and be in full
force thirty (30) days from and after its adoption and approval.
