AN ORDINANCE OF THE CITy I OF GILRY AMENDING SECTION
19.79 OF THE GILROY CITY,CODE SO AS TO PROVIDE THAT
ALL CHARGES .RELATING TO SANITARY SE~R SERVICE SHALL
BE ESTABLISHED BY RESOLUTION OF THE GILROY CITY
COUNCIL, AND REPEALING CONFLICTING PROVISIONS.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
SECTION I. Section 19.79 of the Gilroy City Code is
amended to read as follows:
Sec. 19.79 Rates for sanitary sewer Service
Rates for sanitary sewer service shall
be as fixed from time to time by resolution
of the Council, a copy of which shall be
kept on fileiat the office of the City Clerk.
SECTION II. Sections 191.80, 19.81, 19.82 and 19.87 are
hereby repealed.
SECTION III. Ail ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION IV. This is an EmergencyOrdinance which shall take
effect i~ediately upon its paissage and approval. The facts and
circumstances giving rise to the emergency are as follows:
New sanitarM sewer service rates must
be implement!ed on March 1, 1980, in
order to meet the requirements of Federal
financing foir the new sewer plant, and the
usual ordinance adoption procedure will
not permit ~he rates to be changed by
that date.-~
This Ordinance was intraduced as an emergency measure and
passed and adopted to become effective immediately and ordered

published by title and summarylin accordance with provisions of
the City Charter at a regular Session of the City Council held on
the 21st day of January, 1980, iby the following vote:
