NANCE NO. 80-9
CITY OF GILROY ENACTING SECTION
TY CODE PERTAINING TO PUBLIC TOILETS.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
SECTION I. Section 6.3 of the Gilroy City Code is enacted
to read as follows:
Sec 6.3 Public Totliets
(a) Scope. ~
(1) This sectiDn shall apply to all gasoline service
stations and food service and beverage establishments where
facilities are proviided to consume food or beverages on
the premises.
(2) This section shall also apply to all other build-
ings and portions t~ereof of 15,000 square feet or more
customarily frequented by the public, where members of the
public customarily enter to transact business with the
occupants thereof, Unless exempted by architectural and
site approval co~ititee, upon showing that public presence
is infrequent or that the average duration of the customary
business carried on Iby the public in such building, or por-
tion thereof, is so ishort that public toilet facilities are
unnecessary.
(b) Facilities required.
(1) Where any !City permit is required to be issued
for a building or p~rtion thereof determined to be subject
to this section, such permit shall require that such build-
ing or portion therE~of provide a clearly marked toilet facility
for each sex, locatEld either in the main building or con-
veniently adjacent ~hereto on the same property so that they
are accessible and Lvailable for the use of the public; such
facilities may be l,cked to prevent abuse provided the keys
are available to the public.
(2) Existing buildings or portions thereof having only
one restroommay be granted an exemption by the architectural
and site committee On the basis of hardship, but such exemp-
tion shall be reconsidered upon each permit application.
(d) This section shall not be construed to require
separate facilities!for employees of the building, but
neither shall this section operate to relieve any other re-
quirements for toilet facilities in any building.

SECTION II. Ail other )rdinances and parts of ordinances
in conflict herewith are hereby! repealed.
SECTION III. This ordinance shall take effect and be in
full force thirty (30) days from and after its adoption and approval.
