Commission of the City of Gilro' the prezoning of a 92.3 acre pa' and WHEREAS, the Planning Comm due notice of a public hearing with the Zoning Ordinance of th has approved a Negative Declara WHEREAS, OBATA BROTHERS have heretofore filed with the Planning ~ petition Z 80-4 in due form requesting ~cel as M2 (General Industrial) District; [ssion of the City of Gilroy has given ~pon the said application, in accordance City of Gilroy, has held the hearing, ~ion under the California Environmental Quality Act, and has made its r,~port to the Council of the City of Gilroy, in which it recommends :hat the 92.3 acre parcel hereinafter described be prezoned as set fo~:th above; and WHEREAS, the Council of the City of Gilroy has fixed the 21st day of April 1980, at the hour of 8100 o'clock p.m. in the Council Chambers in the City Hall at 7390 Rosann~ Street, Gilroy, California, as the time and place for hearing the Said report and recommendation upon the said application, and notice oflthe said hearing has been given in accordance with the said Zoning been held upon the said applical Ordinance, and a public hearing has now :ion before the Council, and the Council having duly considered the said,application and the evidence presented, has approved the Negative Decla~:ation under the California Environmental Quality Act, and has determined that the said Zoning Ordinance should be amended in accordance with the report of the said Planning Commission, NOW, THEREFORE, THE COUNCI~ OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: ORDINANCE NO. 80-16 Section 1: The Zoning Ordinance of the City of Gilroy is hereby amended by prezoning to become in an M2 District, as the same Ordinance of the City of Gilro' Ail that property lo Clara, State of Cali~ effective upon annexation and placing i~ described and defined in the Zoning the following described premises: aired in the County of Santa ~ornia, described as follows: That 92.3 acre parcel! on the west side of Luchessa Avenue, east of the :~outhern Pacific Railroad tracks, being Santa Clara Co~mty Assessor'~ Parcel No. 841-15-002. i Section 2: The official map constituting a part of the Zoning Ordinance of the City of Gilroy shall be amended to reflect the fore- going changes of classification of the said property. Section 3: Ail ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4: This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval, and upon annexation of said property to! the City of Gilroy.
