Ordinance 1980-32 ORDINAI~(:E NO. 80-32 ORDINANCE OF THE CITY £~F GILROY A~ENDING THE ZONING ORDINANCE OF SAID CITy BY REZONING THE PARCEL AT 164 WEST SIXTH STREET FROM R3X (HIGH-DENSITY MULTIPLE RESIDENCE) DISTRICT TO~C~ (NEIGHBORHOOD COMMERCIAL) DISTRICT. /i WHEREAS, application Z 80-17 has heretofore been made by WILLIAM HEMPHILL to the Planning Commission of the City of Gilroy for the rezoning of the premises hereinafter described from R3X to C1 District; and WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, has approved ~ Negative Declaration under the California Environmental Quality Act, has determined that the re- zoning will not have a significant adverse affect on the environment, and has made its report to the Council of the City of Gilroy, in which it recommends that the hereinafter described premises be re- zoned from R3X (High-Density Multiple Residence) District to C1 (Neighborhood Cormnercial) District; and WRIEREAS, the Council of the City of Gilroy has fixed the 27th day of October, 1980, at the hour of 8:00 o'clock p.m. in the Council Chambers in the City Ha~l at 7351 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon the said application, at the time and place fixed in ~he said notice before the Council, and the Council having duly considered the said application and the evidence presented, has approved the Negative Declaration under the California Environmental Quality Act, and has determined that the ORDINANCE NOo 80-32 -1- said Zoning Ordinance should be ~mended in accordance with the report of the said Planning Commission. NOW, THEREFORE,~ THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: 'Sect'ion 1~ The Zoning iOrdinance of the City of Gilroy is hereby amended by removing from R3X District and placing in C1 District, as the same are described and defined in the Zoning Ordinance of the City of Gilroyl, the following described premises: Ail that certain real property situated in the City or Gilroy, County of Santa Clara, State ~f California, described as follows: The parcel at identified as Assessor's Pa 164 West Sixth Street, Santa Clara County reel No. 799-08-09 Section 2: The official map constituting a part of the Zoning Ordinance of the City of!Gilroy shall be amended to reflect the foregoing changes of classification of the said property° Section 2: All ordinances and parts of ordinances in conflict herewith are hereby repealed.
