Ordinance 1981-06ORDINANCE NO. 81-6 ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY PREZONING A 223 ACRE PARCEL, 100 ACRES AS M2 PUD (GENERAL INDUSTRIAL PLANNED UNIT DEVELOPMENT) DISTRICT AND THE REMAINING 123 ACRES AS OS (OPEN SPACE) DISTRICT FOR A MINIMUM OF FIVE YEARS, ADJOINING THE CITY OF GILROY NORTHEAST OF SANTA TERESA BOULEVARD BETWEEN UVAS CREEK AND MILLER AVENUE. WHEREAS, FILICE FAMILY ESTATES, LTD. for ADVANCED MICRO DEVICES has filed with the Planning Coum, ission of the City of Gilroy petition Z 80-18 in due form requesting the prezontng of a 223 acre parcel, 100 acres as M2 PUD (General Industrial Planned Unit Development) District and the remaining 123 acres as OS (Open Space) District for a minimum of five years; and WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, has recommended certification of an Environmental Impact Report under the California Environmental Quality Act, has determined that, with mitigation measures as recommended, the rezoning will not have a significant adverse effect on the environ- ment, and has made its report to the Council of the City of Gilroy, in which it recommends that the 223 acre parcel hereinafter described be prezoned as set forth above; and WHEREAS, the Council of the City of Gilroy has fixed the 2nd day of February, 1981, at the hour of 8:00 o'clock p.m., in the Council Chambers in the City Hall at 7351 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon the said application ORDINANCE NO. 81-6 -1- before the Council, and the Council having duly considered the said application and the evidence presented, has certified the Environmental Impact Report under the California Environmental Quality Act, has determined that, with seventeen specified miti- gation measures previously approved, the rezoning will not have a significant adverse effect on the environment, and that any significant effects not fully mitigated are outweighed by the beneficial effects of the project in terms of the creation of jobs and of a balance of jobs and housing, and has determined that the said Zoning Ordinance should be amended in accordance with the report of the said Planning Commission. NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: Section 1: The Zoning Ordinance of the City of Gilroy is hereby amended by prezoning to become effective upon annexation and placing in M2 PUD and OS Districts, as the same are described and defined in the Zoning Ordinance of the City of Gilroy, the following described premises with the OS zoning to remain in effect for a minimum of five years from the date of annexation: Ail of that real property located in the County of Santa Clara, State of California, described as follows: To M2 PUD, Parcel 3, and to OS for a minimum of five years, Parcels 1 and 2, as shown on the attached map of that 223 acre parcel Northeast of Santa ~ Teresa Boulevard between Uvas Creek and Miller Avenue, being Santa Clara County Assessor's Parcel No. 808-18-005. Section 2: The official map constituting a part of the Zoning Ordinance of the City of Gilroy shall be amended to reflect the foregoing changes of classification of the said property. ORDINANCE NO. 81-6 -2- Section 3: All ordinances and parts of ordinances in con- flict herewith are hereby repealed.
