AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTION
16o13-1 OF THE GILROY CITY CODE SO AS TO DEFINE
NUDITY AS USED IN THAT SECTION°
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
SECTION I. Section 16o13-1 of the Gilroy City Code is
amended to read as follows:
Sec. 16.13-1o
Nudity of waiter, waitress, entertainer
z'n foo and beverage establzshmentSo
Any person, with or without compensation, who acts as
a waiter, waitress, or entertainer, in any establish-
ment which serves food, beverages, or food and beverages,
for consumption on the premises of such establishment
and performs such activity in the nude, is guilty of an
infraction.
"Nude" as used in this ordinance means the uncovered or
less than opaquely covered:
(a) Male or female genitals;
(b) Pubic areas;
(c) Buttocks;
(d)
Female breast below a point immediately
above the top of the nipple;
(e)
Female breast with only the nipple and
areola covered.
SECTION IIo Ail other ordinances and parts of ordinances
in conflict herewith are hereby repealed°
SECTION IIio This ordinance shall take effect and be in
full force thirty (30) days from and after its adoption and approval°
PASSED AND ADOPTED this 6 th day of July, 1981, by the
following vote:
