Ordinance 1982-15ORDINANCE NO. 82-15 ORDINANCE OF THE CITY OF GILROY AMENDING SECTION 4 OF ORDINANCE NO. 81-21, THE INDUSTRIAL DEVELOPMENT ORDINANCE. THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: SECTION I. Section 4 of the Industrial Development Ordinance No. 81-21 is amended to read as follows: Section 4 Annual Jobs/Housin~ Balance Evaluation A. Criteria for Maintaining Jobs/Housing Balance Once each year, (in conjunction with the setting of the three-year Numerical Limits for housing) the City Council shall review economic conditions, availability of public services, environmental constraints, available housing, unemployment levels, traffic patterns,and other studies relevant to the industrial development program. Based on these studies, the Council shall consider the amount of new employment in the subsequent three years which the City can sustain without creating a surplus of Jobs in relation to housing. The City Council may assign a build-out schedule for up to three (3) years for any industrial development approved under the provisions of this ordinance. B. Monitoring of New Employment Levels Ail industrial developments, subject to this ordinance, shall be required to submit an accurate estimate of total permanent and temporary employment generated by the development. Estimates shall be required on all applications for architectural and site. revi~w. In addition, all industrial businesses, except those exempted by Section 3.B. of this ordinance, shall submit an accurate count of all permanent and temporary employees during the previous year with each annual business license application or renewal. C. Implementation to Maintain a Jobs/Housing Balance All. industrial development projects which are subject to this ordinance shall be processed in accordance with the provisions of the zoning ordinance until a balance of Jobs to housing is reached. When a balance of Jobs to housing has been reached (or exceeded); the City Council shall take action to create and maintain a balance of Jobs to housing. Applications for splitting, consolidating or rezoning industrial parcels or those which are exempt under the provisions of Section 3.B. of this ordinance shall not be affected by the provisions of this ordinance. ORDINANCE NO. 82-15~ -1- SECTION II. All other ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION III. This ordinance shall take effect and be in full force thirty (30) days from and after its adoption and approval.
