AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTIONS
68.4, 68.10, 68.12 AND 68.14 OF THE ZONING ORDINANCE
RELATING TO FREESTANDING, PORTABLE, AWNING AND PRO-
HIBITED SIGNS
WHEREAS, the Planning Commission of the City of Gilroy has
on its own motion studied the advisability of amending the Zoning
Ordinance of the City of Gilroy; and
WHEREAS, the Planning Commission of the City of Gilroy has
given due notice of a public hearing upon the proposed amendment
in accordance with the Zoning Ordinance of the City of Gilroy, has
held the hearing, has granted a Catagorical Exemption under the
California Environmental Quality Act, and has made its report to
the Council of the City of Gilroy, in which it recommends that
Sections 68.4, 68.10, 68.12 and 68.14 of the Zoning Ordinance re-
lating to signs be amended; and
WHEREAS, the Council of the City of Gilroy has fixed the
21st day of June, 1982, at the hour of 8:00 p.m. in the Council
Chambers in the City Hall at 7351 Rosanna Street, Gilroy, California,
as the time and place for hearing the said report and recommendation
upon the proposed amendment, and due notice of the said hearing has
been given in accordance with the said Zoning Ordinance, and a public
hearing has now been held upon the said application, at the time and
place fixed in the said notice, before the Council, and the Council
having duly considered the proposed amendment and the evidence pre-
sented, has determined that the Catagorical Exemption under the
California Environmental Quality Act should be approved, and that
the Zoning Ordinance should be amended in accordance with the report
of the said Planning Commission.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN
AS FOLLOWS:
Section 1: Section 68.4 of the Zoning Ordinance shall be
amended as follows:

Sec. 68.4 (a) PHYSICAL TYPES OF SIGNS
(3) Portab'Ie~ sign is a sign which is movable,
and is not structurally attached to the ground nor
to a building, a structure or any other sign. Such
sign may or may not be in the configuration of an "A".
(8) 'Freestand%ng 'sign is a sign which is wholly
or partly suppOrted by a structural element which is
not an integral part of a building. Portable signs
and signs on fences shall be considered freestanding
signs.
(10) Monument sign is a low-profile freestanding
structure seven (7) feet or less in height.
Section 2: Section 68.10 of the Zoning Ordinance shall be
amended as follows:

(d) Master shopping center sign or group sign
shall be permitted if the~e are ~6 Ieas~t four (4)-
occupants in a building or shopping center and may be
permitted in addition to the maximum area of signing
permitted under section 68.10(b) subject to securing
approval of the architectural and site approval
committee. Where a master shopping center sign is
used additional freestanding signs for individual
businesses will not be allowed.
(i) Maximum number and area of freestanding signs:

tive with signs over seventy-five (75) square feet sub-
ject to approval of the architectural and site review
committee and signs under seventy-five (75) square feet
to be approved by the planning director. An individual
business shall not be permitted to have a freestanding
sign where there is a master shopping center or group
sign. The area of the freestanding sign shall be in-
cluded in the maximum area allowed under section 68.10
(b). The planning director may request the architec-
tural and site review committee to review a sign under
seventy-five (75) square feet. All decisions under
this section may be appealed to the Planning Commission.
Section 3: Section 68.12 of the Zoning Ordinance shall be
amended as follows:
68.12 Prohibited signs:
(a) Signs on the roof of a structure or which
from the public ri. ght-of-way appear to be roof signs,
except as noted in (b).

(j) Signs projecting into a public street,
alley or identifiable pedestrian way more than 12
inches excluding signs allowed on awnings.
(v) Signs higher than three (3) feet above the
sidewalk elevation or less than seven (7) feet above
grade on a corner lot within a triangle formed by the
curb lines as extended and a line connecting those
lines from points thereon which lie thirty (30) feet
from the intersection of the curb lines.
(w) Signs higher than three (3) feet above the
sidewalk elevation or less than seven (7) feet above
grade within five (5) feet of the intersection of any
access drive and public sidewalk.
Section 4: Section 68.14 of the Zoning Ordinance shall be
amended as follows:
68.14 Awnings: Signs shall not be placed upon, attached
to, or constructed on any awning, except for signs
printed, painted, marked, stamped or otherwise impressed
upon the surface of an awning so that it is an integral
part of the fabric, which is parallel with the front of
the building. Awning signs shall only be permitted on
the vertical surface or surface within 10 degrees (10°)
of vertical and shall not occupy more than 20 percent
(20%) of the total surface area of the awning.
Section 5: Ail ordinances and parts of ordinances in conflict
herewith are hereby repealed.
Section 6: This ordinance shall take effect and be in full
force thirty (30) days from and after its passage and approval.
