ORDINANCE OF THE CITY OF GILROY AMENDING
ORDINANCE NO. 79-28, THE RESIDENTIAL DEVELOPMENT
ORDINANCE, BY ADDING SECTION 4 B. 5 THERETO
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN
AS FOLLOWS;
SECTION I. The Residential Development Ordinance
No. 79-28 is amended by adding Section 4 B.5 thereto to read
A residential development project previously
assigned a build-out schedule under the
provisions of this Ordinance, is exempt if:
a. All necessary public improvements serving
the project have been constructed and
accepted by the City of Gilroy, and
b. At least four units of the approved build-
out have been built and granted occupancy.
SECTION II. All other ordinances and parts of ordinances
in conflict herewith are hereby repealed.
SECTION III. This ordinance shall take effect and be in
full force thirty (30) days from and after its adoption and
approval.
