AN ORDINANCE OF THE CITY OF GILROY
~ENDING SECTION 2§A.2 OF THE GILROY
CITY CODE TO INCREASE THE TRANSIENT
OCCUPANCY TAX TO NINE PERCENT.
THE CITY COUNCIL OF THE CITY OF GILROY DOES
ORDAIN AS FOLLOWS:
SECTION I. Section 25A.2 of the Gilroy City
Code is amended to read as follows:
Sec. 25A.2. Tax imposed.
For the privilege of occupancy in
any hotel, each transient is subject to and
shall ~ a tax in the amount of nine per-
cent ( of the rent charged by the operator.
Said tax constitutes a debt owed by the
transient to the cit~ which is extinguished
only by payment to the operator or to the city.
The transient shall pay the tax to the operator
of the hotel at the time the rent is paid.
If the rent is paid in installments, a pro-
portionate share of the tax shall be paid with
each installment. The unpaid tax shall be
due upon the transient's ceasing to occupy
space in the hotel. If for any reason the
tax due is not paid to the operator of the hotel,
the director of finance may require such tax
shall be paid directly to the director of finance.
SECTION II. All other ordinances and parts of
ordinances in conflict herewith are hereby repealed.
SECTION III. This ordinance shall take effect and
be in full force thirty (30) days from and after its adoption
and approval.
