AN ORDINANCE OF THE CITY OF GILROY AMENDING
SECTION 26B.15 AND ENACTING SECTIONS 26B.16.1
and 26B.16.2 OF THE GILROY CITY CODE IMPOSING
A STEAM USERS UTILITY TAX
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN
AS FOLLOWS:
SECTION I. Section 26B.15 of the Gilroy City
Code is amended to read as follows:
Sec. 26B.15 -EXclusions~
As used in this Article, the term "charges"
shall not include charges made for gas used in
the generation of electrical energy, by·a _public
utility, a qualifying cogeneration fa~ili~t¥, or
a governmental agency, an~ the term ~Using/gas"
shall not be construed to mean the mere receiving
of such gas by a gas corporation or governmental
agency at a point within the city for resale,
SECTION II. Article IV..A of Chapter 26B consisting
of Sections 26B.16,1 and 26B,16~2 is enacted to read as follows:
ARTICLE IV.A -STEA}f USERS TAX
Sec. 26B.16.~1 - Tax imposed,
There is hereby imposed a tax upon every
person in the city using steam or hot water delivered
through mains or pipes as an industrial energy
resource in the city. The tax imposed by this
article shall be at thc rate of 5% of the charges made
for such steam or hot water~ including minimum
charges for service, and shall be paid by the person
paying for such'steam or hot water~
Sec. 26B.16.2 - Tax collection.
The tax imposed in this Article shall be
collected from the service user by the person selling
steam or hot water heat. The amount collected
in onemonth shall be remitted to the collector on
or before the last day of the following month.

SECTION III. Ail other ordinances and parts of
ordinances in conflict herewith are hereby repealed,
SECTION IV. This ordinance shall take effect
and be in full force thirty (30) days from and after its
adoption and approval.
