Ordinance 1986-02ORDINANCE NO, 86-2 AN ORDINANCE OF THE CITY OF GILROY ENACTING SECTION 12.18A OF THE GILROY CITY CODE PROVIDING FOR TEMPORARY PLACEMENT OF DEBRIS BOXES IN 'sTREETS. THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: SECTION I. Section 21.39 of the Gilroy City Code is enacted to read as follows: Sec. 12.18A. Deb'ris 'BoXes Debris boxes may be placed on public streets or in alleys in accordance with the conditions of a permit issued by the Director of Public Works. Such placement shall not exceed a period of six (6) calendar days. Debris boxes are defined as metal containers designed to be loaded and unloaded onto a truck trailer by means of a winch and cable. They are co~mnonly known as "transfer rigs". Such boxes shall not be wider than eight feet (8') nor higher than six feet (6'). SECTION II. Ail other ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION III. This is an Emergency Ordinance which shall take effect immediately upon its passage and approval. The facts and circumstances~giving rise to the emergency are as follows: For many years debris boxes have been placed temporarily in streets with the tacit approval of the City. A person who drove a vehicle into such a box recently filed a claim against the disposal company because our code prohibits garbage containers in streets. Immediate enactment is necessary to prevent another such claim. This Ordinance was introduced as an emergency measure and passed and adopted to become effective immediately and ordered published by title and summary in accordance with ORDINANCE NO. 86-2 -1-- provisions of the City Charter at a regular session of the City Council held on the 20th day of January 1986, by the following vote: AYES: COUNCILM~M~ERS: ALBERT, GAGE, KLOECKER, MUSSALLEM, PALMERLEE, VALDEZ and HUGHAN NOES; COUNCILMEMBERS: NONE ABSENT; COUNCILMAqVlBERS: NONE ORDINANCE NO. 86-2 -2-- I, SUSANNE E.
