Ordinance 1988-07ORDINANCE NO. 88-7 AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTIONS 2.47, 2.48, 2.51 AND 2.52 OF THE GILROY CODE SO AS TO PERMIT MERGER OF POLICE AND FIRE DEPARTMENT MANAGEFfENT UNDER A PUBLIC SAFETY DIRECTOR. THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: SECTION I. Section 2.47 is amended to read as follows: Sec. 2.47. Chief of police or public safety, director - ~n~ent. The police department shall be under the direct supervision of a chief of police, or if management is merged with that of the fire department by council resolution then a public safety director, who shall be appointed by the city administrator, with the consent of the council. SECTION II. Section 2.48 is amended to read as follows: Sec. 2.48. Same - Power~ and duties. In all cases where the duty is not expressly charged to any other department or office, it shall be the duty of the chief of police or public safety director to act to preserve the peace and maintain law and order in the city. It shall be the duty of the chief of police or public safety director to manage the functions of the department of police. SECTION III. Section 2.51 is amended to read as follows: Sec. 2.51. Fire chief or public safety director - A-~i~ment. The department of fire shall be under the direct supervision of the fire chief, or if management is merged with that of the police department by council resolution then a public safety director, who shall be appointed by the city administrator, with the consent of the council. ORDINANCE NO. 88-7 -1- SECTION IV. Section 2~52 is amended to read as follows: Sec. 2.52. Same - Powers and duties. In all cases where the duty is not expressly charged to any other department or office, it shall be the duty of the fire chief or public safety director to protect life and property by preventing and eliminating fire hazards and by controlling and extinguishing fires. Ail other ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION VI. This ordinance shall take effect and be in full force thirty (30) days from and after its adoption and approval.
