AN ORDINANCE OF THE CITY OF GILROYAMENDING
SECTIONS 12.23-1, 19.88, 19.89, 19.~91, 27.36
AND 27.36-1 OF TH]{ GILROY CITY CODE SO AS TO
ESTABLISH A UNIFOPd~DELINQUENCY POLICY FOR
UTILITY BILLINGS.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN
AS FOLLOWS:
SECTION I. Sections 12.23-1, 19.88, 19.89, 19.91,
27.36 and 27.36-1 of the Gilroy City Code are amended to
read as follows:
Sec. 12.23-1.~ penalty 'for 'delinq~ency.
Garbage, rubbish or refuse collection fees or
charges collected by the city become delinquent for not
being paid on or before'the last day of the month billed.
Thereafter there shall be imposed a penalty equal to ten
per cent (10%) of the amount due for each full month of
delinquency.
Sec. 19.88.' Due date.
All sewer service and use charges are due and payable
on or before the last day of the month billed.
Sec. 19.89. Payment - Billing.
Ail charges for sewage service and industrial use
established by this article shall be paid to and collected
by the director of finance of the city. Such charges may
be billed upon the same bill used for the collection of
charges for water and may be collected as one item, but a
separate account shall be kept in the office of the director
of finance of the amounts for all charges made for sewage
service and use and the amount collected therefor.
If a bill for sewage service and use becomes delinquent,
the director of finance shall send a written notice to the
user that if the bill is not paid within ten (10) days, sewer
service shall be discontinued.
On failure to comply with the rules and regulations
established as a condition of the use of the sewage service om
to pay the rates or any penalty imposed in the time and manner
provided by this article, water may be shut off on any and all
service where the delinquent user is being supplied with water
until payment of the amount due.

Charges for water service and use become delinquent
if not paid on or before the last day of the month billed.
If a hill for services becomes delinquent, the director of
finance shall send the user a written notice that if the
bill is not paid within ten (10) days, the water service
shall be discontinued.
Sec. 27.36,1. penalty for delinquency.
Water charges become delinquent for not being paid
on or before the last day of the month billed. Thereafter
there shall be imposed a penalty equal to ten per cent
(10%) of the amount due for each full month of delinquency.
SECTION II. Ail other ordinances and parts of ordinances
in conflict herewith are hereby repealed.
SECTION III. This ordinance shall take effect and be in
full force thirty (30) days from and after its adoption and
approval.
