AN ORDINANCE OF THE CITY OF GILROY CREATING A
HANDICAPPED ACCESS APPEALS BOARD
Upon the recommendation of the Chief Building Inspector and
the Building Department Board of Appeals and good cause appearing
therefor,
THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
SECTION I. Under the authority of Gilroy Charter Section
920, there is hereby created the HANDICAPPED ACCESS APPEALS BOARD
for the City of Gilroy, as described in Health and Safety Code
section 19957.5.
SECTION II. The board shall consist of five members to be
appointed by the Mayor with the consent of the Council for four
year terms, with the members first appointed to classify
themselves so that the term of at least one member shall expire
each succeeding January first.
SECTION III. Two members shall be physically handicapped
persons, two members shall be persons experienced in
construction, and one member shall be a public member.
SECTION IV. The appeals board shall meet as necessary to
conduct hearings on written appeals brought by any person
regarding action taken by the Building Department in enforcement
of the requirements of Health and Safety Code Division 13, Part
5.5 entitled, "Access to Public Accommodations by Physically

Persons", and consisting of Sections 19955 to 19959

inclusive as it now exists or may hereafter be amended,
the interpretation or application of any other state or
regulation pertaining to handicapped access.
SECTION V. The appeals board hereby created shall adopt
regulations for its organization and for procedural rules and
criteria for carrying out its duties.
SECTION VI. All other ordinances and parts of ordinances in
conflict herewith are hereby repealed.
