Ordinance 1991-20ORDINANCE NO. 91- 20 AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTIONS 19.80, 19.102(d), 19.102(k), AND 19.102(p) OF THE GILROY CITY CODE RELATING TO SEWER USE THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: SECTION I. Section 19.80 of the Gilroy City Code is hereby amended to read as follows: Section 19.80. Types of charges for industrial user. The types of charges for industrial use may include, but are not limited to: (a) Fees for permit application. (b) Fees for monitoring, inspections and surveillance. (c) Surcharges for discharges in excess of 300 mg/1 BOD, TSS, volume and other discharge constituents. (d) Other fees as the city may deem necessary to carry out the requirements contained herein. SECTION II. Section 19.102(d) of the Gilroy City Code is hereby amended to read as follows: (d) Wastes having a monitored pH lower than 6.5 or higher than 11.0, or having any corrosive property capable of causing damage or hazards to structures, equipment, or personnel of the public sewer systems. Where the City Administrator or authorized representative deems it advisable, it may be required that any person discharging industrial wastes install and maintain in approved manner a suitable device to continuously measure and record the pH of the wastes so discharged. SECTION III. Section 19.102(k) of the Gilroy city Code is hereby amended to read as follows: (k) Wastes containing visible amounts of grease, oil or other substances in concentrations or flows sufficient to cause stoppage, pluggage, breakage, or obstruction of flow to the treatment system, or cause any other damage or increased maintenance of the collection system. SECTION IV. Section 19.102(p) of the Gilroy City Code is hereby amended to read as follows: (p) Waste water containing in excess of: 0.4 mg/1 arsenic 0.01 mg/1 cadmium 0.6 mg/1 copper \210\047060OW.T50 ORDINANCE NO_ __ql-2Ol_ 11-082704706-002:tc ' 0.1 0.4 0.01 0.9 1.0 4.0 1.0 1.0 1000 1000 mg/1 cyanide mg/1 lead mg/1 mercury mg/1 nickel mg/1 silver mg/1 total chromium mg/1 zinc mg/1 phenolic compounds mg/1 biochemical oxygen demand (BOD) mg/1 total suspended solids (TSS) Trace mg/1 total identifiable chlorinated hydrocarbons Trace mg/1 toxic organic compounds (priority pollutants as defined by the Environmental Protection Agency). SECTION V. This ordinance shall take effect and be in full force thirty (30) days from and after its adoption and approval.
