AN ORDINANCE OF THE CITY OF GILROY APPROVING REZONING
REQUEST NO. Z 91-06 AND CHANGING THE ZONING DESIGNATION
FROM R2 TO R2 PUD ON APN 841-07-057, LOCATED AT THE
NORTHERLY TERMINUS OF HOOVER COURT
WHEREAS, this rezoning request came regularly before the
Planning Commission at a duly noticed public hearing on October 3,
1991, and after hearing and considering the evidence, the Planning
Commission unanimously adopted Res. 91-17 approving the request;
and
WHEREAS, the application came regularly before the City
Council at a duly noticed public hearing on October 7, 1991, at
which time the City Council reviewed and cOnsidered the record
before the Planning Commission and considered additional evidence
presented to it on October 7; and
WHEREAS, this request is exempt from the California
Environmental Quality Act pursuant to State CEQA Guideline 15305;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY
DOES ORDAIN AS FOLLOWS:
SECTION I. The city Council finds that the zone
change will allow for a better-designed residential project without
increasing its density, that the proposal is consistent with the
site's land use designation in the General Plan, and that the
proposal is consistent with the use of surrounding parcels.
SECTION II. Rezoning request Z 91-06 is hereby
approved, and the zoning map is changed from R2 to R2'PUD on the
parcel located at the northerly terminus of Hoover Court, APN 841-
ORDINANCE NO. 91 - 22 -1-
07-057.
SECTION III.
