AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GILROY APPROVING Z 92-08, PREZONING FROM
COUNTY AGRICULTURE AND HIGHWAY COMMERCIAL TO
C3-PUD (SHOPPING CENTER COMMERCIAL - PLANNED
UNIT DEVELOPMENT) DISTRICT ON APPROXIMATELY
16.5 ACRES, AND REZONING FROM AGRICULTURE (Al)
TO C3-PUD (SHOPPING CENTER COMMERCIAL -
PLANNED UNIT DEVELOPMENT) DISTRICT ON APPROXI-
MATELY 1.5 ACRES, LOCATED ON THE EAST SIDE OF
SAN YSIDRO AVENUE, NORTH OF LEAVESLEY ROAD AT
ARROYO CIRCLE INTERCHANGE
WHEREAS, the Glen Loma Corporation has submitted applica-
tion Z 92-08 to amend the zoning map of the City of Gilroy to
prezone approximately 16.5 acres located on the east side of San
Ysidro Avenue, north of Leavesley Road at Arroyo Circle Inter-
change, from County Agriculture and Highway Commercial to the
C3-PUD (Shopping Center Commercial - Planned Unit Development)
District, and to rezone approximately 1.5 acres already within the
City limits from Agriculture (Al) to the C3-PUD (Shopping Center
Commercial - Planned Unit Development) District, affecting APNs
835-04-017, 835-04-041, and 835-04-042, as such lands are shown on
the map attached hereto as Exhibit A and incorporated herein by
this reference; and
WHEREAS, the City prepared and circulated in accordance
with the California Environmental Quality Act ("CEQA") an Environ-
mental Impact Report ("EIR") for this project; and
WHEREAS, in connection with a related action (GPA 90-05),
the City Council duly certified the EIR on September 21, 1992,
finding that it was complete and in compliance with CEQA, that it
reflected the independent judgment of the City and that the city
Council had reviewed and considered the information therein; and
WHEREAS, in conjunction with its certification of the EIR
and approval of GPA 90-05, the City Council duly made findings
required by Public Resources Code section 21081 regarding project
impacts and project alternatives, and adopted a mitigation monitor-

ing program for this project as required by Public Resources Code
section 21081.6; and
WHEREAS, the Planning Commission held a duly noticed
public hearing on Z 92-08 on February 4, 1993, and voted unani-
mously to adopt Resolution No. 93-4, recommending approval of
Z 92-08; and,
WHEREAS, the city Council held a duly noticed public
hearing on Z 92-08 on February 16, 1993;
THE CITY COUNCIL OF THE CITY OF GILROY HEREBY ORDAINS AS
FOLLOWS:
SECTION I
The City Council finds that the City has properly taken
all actions required by CEQA.
SECTION II
Application Z 92-08 should be and hereby is approved,
subject to the mitigation measures set forth in the EIR and the
mitigation monitoring program, and the Gilroy zoning map is hereby
amended to prezone approximately 16.5 acres, APNs 835-04-017, -042,
from County Agriculture and Highway Commercial to the C3-PUD
(Shopping Center Commercial - Planned Unit Development) District,
and to rezone approximately 1.5 acres, APN 835-04-041, from
Agriculture (Al) to the C3-PUD (Shopping Center Commercial -
Planned Unit Development) District, all located on the east side
of San Ysidro Avenue, north of Leavesley Road at Arroyo Circle
Interchange, as such lands are shown on the map attached hereto and
incorporated herein as Exhibit A.

SECTION III
This ordinance shall take effect and be in full force
thirty (30) daYs from and after its adoption and approval.
