Ordinance 1993-06ORDINANCE NO. 93- 6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING Z 93-01, REZONING FROM MI (LIMITED INDUSTRIAL) TO C3-PUD (SHOPPING CENTER COMMERCIAL - PLANNED UNIT DEVELOPMENT) ON APPROXIMATELY 11.472 ACRES LOCATED ON THE WEST SIDE OF SAN YSIDRO AVENUE BETWEEN LAS ANIMAS AVENUE AND LEAVESLEY ROAD, APN 835-04-056 WHEREAS, the Glen Loma Corporation has submitted applica- tion Z 93-01 to amend the zoning map of the City of Gilroy to rezone approximately 11.472 acres located on the west side of San Ysidro Avenue between Las Animas Avenue and Leavesley Road, APN 835-04-056, from Mi (Limited Industrial) to C3-PUD (Shopping Center Commercial - Planned Unit Development), as such land is shown on the map attached hereto as Exhibit A and incorporated herein by this reference; and WHEREAS, the City prepared and circulated in accordance with the California Environmental Quality Act ("CEQA") an Environ- mental Impact Report ("EIR") for this project; and, WHEREAS, in connection with a related action (GPA 90-07) the City Council duly certified the EIR on November 2, 1992, finding that it was complete and in compliance with CEQA, that it reflected the independent judgment of the city, and that the City Council had reviewed and considered the information therein; and, WHEREAS, in conjunction with the certification of the EIR and approval of GPA 89-07, the city Council duly made findings required by California Public Resources Code section 21081 regard- ing project impacts and project alternatives, adopted a statement of overriding considerations for this project pursuant to CEQA Guideline 15093, and adopted a mitigation monitoring program for this project as required by Public Resources Code section 21081.6; and, WHEREAS, the Planning Commission held a duly noticed public hearing on Z 93-01 on February 4, 1993 and after that public hearing voted unanimously to adopt Resolution No 93-3, recommending ORDINANCE NO. 93 - 6 -1- approval of Z 93-01; and, WHEREAS, the City Council held a duly noticed public hearing on Z 93-01 on February 16, 1993; THE CITY COUNCIL OF THE CITY OF GILROY HEREBY ORDAINS AS FOLLOWS: SECTION I The city Council hereby finds that the City has properly taken all actions required by CEQA. SECTION II Application Z 93-01 should be and hereby is approved subject to the mitigation measures set forth in the EIR and the mitigation monitoring program, and the zoning map of the City of Gilroy is hereby amended to rezone approximately 11.472 acres located on the west side of San Ysidro Avenue between Las Animas Avenue and Leavesley Road, APN 835-04-056 from Mi (Limited Industrial) to C3-PUD (Shopping Center Commercial - Planned Unit Development), as shown on the map attached hereto as Exhibit A. SECTION III This ordinance shall take effect and be in full force thirty (30) days from and after its adoption and approval.
