AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GILROY AMENDING SECTION 2.41 OF THE GILROY
MUNICIPAL CODE TO REFLECT CITY POLICY WITH
RESPECT TO PURCHASES OF RECYCLED PAPER
PRODUCTS
WHEREAS, state law encourages local governments to
purchase and use recycled products and recycled products; and
WHEREAS, the city of Gilroy has determined that the use
of recycled products may be furthered by instituting goals for City
purchases of products.
THE CITY COUNCIL OF THE CITY OF GILROY DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION I
Section 2.41(b)(4) of the Gilroy Municipal Code is hereby
amended to read as follows:
(4) Competitive Processes. Establish and utilize competitive
processes by endeavoring to purchase at the lowest price
consistent with the quality required, except:
(A) a three percent (3%) preference may be given to
vendors licensed to do business at a fixed place
within the city, if all vendors are notified in
advance, if the product is of comparable quality,
and if it is not for a public project; and,
(B)
ten percent (10%) of all paper products purchased
by the City may be required to be recycled paper
products as defined in Public Contract Code section
12161 (as it may be amended), and .the vendors or
suppliers of such recycled paper products shall
certify to the city under penalty of perjury that

their recycled paper products meet the statutory
definition.
This ordinance shall take effect and be in full force
thirty (30) days from and after its adoption and approval.
