AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GILROY AMENDING SECTION 15.53 OF THE GILROY
CITY CODE TO PROHIBIT THE DISPLAY OF VEHICLES
FOR SALE ON STREETS IN AREAS WITH ZONING
DESIGNATION M1, M2 (INDUSTRIAL), PO (PROFES-
SIONAL OFFICE), Cl (NEIGHBORHOOD COMMERCIAL),
C2 (CENTRAL COMMERCIAL), C3 (SHOPPING CENTER
COMMERCIAL OR CM (COMMERCIAL INDUSTRIAL), AND
TO PROHIBIT THE GREASING, MAINTENANCE OR
REPAIR OF VEHICLES ON ANY CITY STREET
WHEREAS, displaying vehicles for sale on streets in areas
with zoning designation Mi, M2 (Industrial), PO (Professional
Office), C1 (Neighborhood Commercial), C2 (Central Commercial), C3
(Shopping Center Commercial) or CM (Commercial Industrial) impedes
the safe and efficient movement of vehicles in said areas, creates
a hazard to pedestrians crossing streets in said areas, and also
results in a visual blight impairing the aesthetic quality of said
areas, thus, posing a threat to the public health, safety, and
welfare; and,
WHEREAS, greasing, maintaining or repairing vehicles
parked on any City street impedes the safe and efficient movement
of vehicles, presents a hazard to pedestrians, creates numerous
potential pollution problems including the discharge of pollutants
into the City storm sewer system, and results in a visual blight
impairing the aesthetic quality of the City, thus, posing a threat
to the public health, safety, and welfare; and,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION I
The City Council hereby finds it necessary and appropri-
ate in order to protect the public health, safety and welfare to
adopt an ordinance amending Section 15.53 of the Gilroy Municipal
Code to prohibit the display of a vehicle for sale on streets in
areas with zoning designation Mi, M2 (Industrial), PO (Professional
Office), Cl (Neighborhood Commercial), C2 (Central Commercial), C3
(Shopping Center Commercial) or CM (Commercial Industrial), and to
prohibit the greasing, maintaining or repairing of a vehicle while
such vehicle is parked on any City street, except when such repair
is necessitated by an emergency.
SECTION II
Section 15.53 of the Gilroy Municipal Code is hereby
amended to read as follows:

Section 15.53 Restrictions on Displaying Vehicles for Sale
and on Repairing Vehicles Parked on City Streets.
No person shall:
(a) Park a vehicle for the purpose of displaying that vehicle
for sale on a street in an area classified according to
the Gilroy Zoning Ordinance with the zoning designations
M1, M2 (Industrial), PO (Professional Office), C1
(Neighborhood Commercial) , C2 (Central Commercial) , C3
(Shopping Center Commercial) or CM (Commercial Industri-
al); or
(b) Grease, maintain or repair a vehicle while such vehicle
is parked on any City street, except when such repair is
necessitated by an emergency.
SECTION III
This ordinance shall take effect and be in full force
thirty (30) days from and after this ordinance's final adoption and
approval.
PASSED AND ADOPTED this 18th day of July, 1994 by the
following vote:
