AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GILROY AMENDING SECTION 2.41(b) (4) OF THE
GILROY CITY CODE PROVIDING FOR THE RESPON-
SIBILITY OF THE CITY PURCHASING AGENT TO
ESTABLISH COMPETITIVE PROCESSES
WHEREAS, Section 2.41(b) (4) of the Gilroy Municipal Code
as presently drafted provides that the city purchasing agent is
responsible for and is required to establish and utilize competi-
tive processes in connection with City purchases; and
WHEREAS, the Council has approved a change to
Section 2.41(b)(4) of the Gilroy Municipal Code to facilitate the
Life Cycle Cost Analysis process to which the City is committed;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION I
Section 2.41(b)(4) of the Gilroy Municipal Code is hereby
amended to read as follows:
(4) Competitive processes. Establish and
utilize competitive processes by endeavoring
to purchase at the lowest total cost
consistent with the quality required, except:
a. A three (3) percent preference
may be given to vendors licensed to
do business at a fixed place within
the city, if all vendors are
notified in advance, if the product
is of comparable quality, and if it
is not for a public project; and
b. Ten (10) percent of all paper
products purchased by the city may
be required to be recycled paper
products as defined in Public
Contract Code section 12161 (as it
may be amended), and the vendors or
suppliers of such recycled paper
products shall certify to the city
under penalty of perjury that their
recycled paper products meet the
statutory definition.

SECTION II
This ordinance shall take effect and be in full force
thirty days from and after its adoption and approval.
