ORDINANCE NO. 95 -1
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GILROY AMENDING SECTION 19.85, RELATING TO
CHARGES FOR SEWER SYSTEM USERS OUTSIDE THE
CITY LIMITS
WHEREAS, Section 19.85 of the Gilroy City Code provides
that sewer users whose premises are located outside the corporate
limits of the city shall be charged three times the rates specified
for their type or class of property as if their property were
located within city limits; and,
WHEREAS, staff recommends that this requirement be
deleted on the basis that recent changes in Federal Law render such
requirement unnecessary.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION I
The City Council hereby finds it no longer appropriate
or in furtherance of the public health, safety and welfare to
require that persons situated outside the city's corporate limits
and using the City's sewer pay three times the amount of charges
as for properties similarly situated inside the corporate
boundaries of the City.
SECTION II
Section 19.85 of the Gilroy City Code is hereby amended
to read as follows:
Section 19.85 Premises Outside City Limits.
No premises located outside the city limits shall be connected
to the city sewer system without an agreement, approved by the
city council, with the city permitting the same. Such sewer
users whose premises are located outside the corporate limits
of the city as may be permitted to connect their premises to
the city sewer system shall be charged for and pay the current
rates as specified for their type or class of property as if
it were located within the city limits.

SECTION III
This ordinance shall take effect and be in full force
thirty (30) days from and after this ordinance's final adoption and
approval.
PASSED AND ADOPTED this 3rd day of January, 1995 by the
following vote:
