Ordinance 1996-10` . • • . ORDINANCE NO. 96 -10 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GILROY REMOVING THE HISTORIC NEIGHBORHOOD DESIGNATION FROM A 6,080 SQUARE FOOT PARCEL OF PROPERTY LOCATED AT 7496 HANNA STREET (APN 799- 18 -61) ZONED R1 -HN (SINGLE FAMILY RESIDENTIAL- HISTORIC NEIGHBORHOOD), Z 96 -01 WHEREAS, the owner of property at 7496 Hanna Street has asked that the Historic Neighborhood designation be removed from this property; and WHEREAS, the 6,080 square foot parcel is zoned R1 -HN (Single Family Residential- Historic Neighborhood) and is located near the southeast corner of Fifth Street and Hanna Street as is more particularly described in the map attached hereto as Exhibit A; and WHEREAS, the Historic Heritage Committee at its meeting on September 21, 1995, considered removing the Historic Neighborhood designation from this parcel, at which meeting it voted to recommend to the Planning Commission that the Historic Neighborhood designation be removed from this parcel; and WHEREAS, the Planning Commission held a duly noticed public hearing at its regularly scheduled meeting on May 2, 1996 for the purpose of determining whether to recommend removing the Historic Neighborhood designation from this property, after which hearing it voted to recommend that this City Council make such change; and WHEREAS, the City Council held a duly noticed public hearing at its regularly scheduled meeting on May 20, 1996; and WHEREAS, the properties located along Hanna Street between Fifth Street and Sixth Street are not designated as an Historic Neighborhood, nor are any of the parcels in the area designated as historic sites; and WHEREAS, the west side of Hanna Street contains approximately six Mission Revival and Craftsman style homes U2PJ1309762.0i -1- ORDINANCE 96 -10 6&070204706002 probably built between 1910 and 1935 that are of an historic character, but the remaining homes on the west side of Hanna Street are not of historic character; and WHEREAS, there are no homes of historic character on the east side of Hanna Street where the subject lot is located, and the property across the street from 7496 Hanna Street is developed with a long, Ranch style home; and WHEREAS, the City Council finds that this property does not have a .significant relationship to the adjacent Historic Neighborhood and removing the Historic Neighborhood designation from the property will not adversely affect the historic homes within the neighborhood; and WHEREAS, none of the criteria for a Historic Neighborhood designation stated in Zoning Ordinance section 27.21 apply to the subject property; and WHEREAS, the proposal is consistent with the land use designation of the General Plan map and will not be detrimental to the public welfare or negatively impact the historic neighborhood along Fifth Street; and WHEREAS, approval of this project is categorically exempt from the environmental review requirements of the California Environmental Quality Act( "CEQA "), Public Resources Code section 21000, et seq., as a Minor Alteration in land Use Limitations within the meaning of CEQA Guidelines section 15305; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY DOES HEREBY ORDAIN AS FOLLOWS: SECTION I The project is consistent with the Gilroy General Plan because it conforms to the land use designation for the property on the General Plan Map and is consistent with the intent of the text, goals and policies of the General Plan. Proposed Map Amendment #1 of Z 96 -01 should be and hereby is approved. B. The Zoning Map of the City of Gilroy is hereby amended to rezone approximately 6,080 square feet located near the southeast corner of Fifth Street and Hanna Street, APN 799- 18 -61, as is more particularly described in Exhibit A, from R1 -HN (Single Family Residential- Historic Neighborhood) to R1 (Single Family Residential). SECTION IV This ordinance shall take effect and be in full force thirty days from and after its adoption and approval.
