AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GILROY PRE-ZONING TO PF (PARK/PUBLIC
FACILITY), RI (SINGLE FAMILY RESIDENTIAL), RH
(RESIDENTIAL HILLSIDE), OS (OPEN SPACE)
PUD(PLANNED UNIT DEVELOPMENT OVERLAY ZONING)
ON APPROXIMATELY 265 ACRES, Z 97-02, APN 783-
06-04, 05, 06, 07, 08, 09, 10; 783-13-03
( PORT I ON)
WHEREAS, City of Gilroy (~Applicant") has submitted Z
97-02 requesting an amendment to the City of Gilroy's Zoning Map
so that certain property is pre-zoned to PF (Park/Public
Facility), Ri (Single Family Residential), RH (Residential
Hillside), OS (Open Space), all with a PUD (Planned Unit
Development) zoning overlay on approximately 265 acres; and
WHEREAS, the property affected by Z 97-02 is located
north and east of Burchell Road, such land being indicated on a
map attached hereto as Exhibit "A" and incorporated herein by this
reference; and
WHEREAS, a Final Environmental Impact Report ("Final
EIR") was prepared for this project (see also related applications
GPA 97-01 and USA 97-01) and was certified in accordance with the
California Environmental Quality Act ("CEQA") by Resolution No.
97-45 by the City Council on July 28, 1997; and
WHEREAS, prior to any Project approvals, the City
Council adopted Resolution No. 97-47, making certain findings
concerning mitigation measures and alternatives, adopting a
mitigation monitoring and reporting program, and adopting a
statement of overriding considerations in accordance with the
requirements of CEQA; and
WHEREAS, the Planning Commission held a duly noticed
public hearing on Z 97-02 on August 4, 1997, and after that
hearing voted to recommend approval of Z 97-02; and
WHEREAS, the City Council held a duly noticed public
hearing on Z 97-02 on July 31, 1997, at which public hearing the
City Council considered the Project and based upon substantial

evidence, including both oral and written testimony, resolved that
the Project should be approved with conditions; and
WHEREAS, the location and custodian of the documents or
other material which constitute the record of proceedings upon
which this ordinance is based is the office of the City Clerk.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION I
The City Council hereby finds that Z 97-02 should be
and hereby is approved for the following reasons:
1. The proposal is consistent with the intent of the
goals and policies of the General Plan document.
2. The City Council has taken all actions required by
CEQA.
3. The project is subject to the mitigation measures
set forth in the Final EIR as described in Resolution No. 97-47,
and the Mitigation Monitoring and Reporting Program.
4. The Zoning Map of the City of Gilroy is hereby
amended to pre-zone approximately 265 acres located north and east
of Burchell Road as described in Exhibit "A".
This ordinance shall take effect and be in full force
thirty days from and after its adoption and approval.
PASSED AND ADOPTED this 2nd day of September, 1997 by
the following vote:

SPRINGER, VALDEZ, ROGERS
NOES: COUNCILMEMBERS: NONE

I, RHONDA PELLIN, City Clerk of the City of Gilroy, do hereby certify that the attached
ordinance No. 97-8 is an original ordinance, duly adopted by the Council of the City of Gilroy at
a regular meeting of said Council held on the 2nd day of September, 1997, at which meeting a
quorum was present.
