ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING
ORDINANCE OF SAID CITY BY PREZONING A 37.028 ACRE PARCEL
ADJOINING THE CITY OF GILROY ON THE SOUTH SIDE OF FIRST
STREET, 300 FEET EAST OF ITS INTERSECTION WITH.SANTA
TERESA BOULEVARD AS C1 (NEIGHBORHOOD COMMERCIAL), R3 (LOW
DENSITY MULTIPLE), R2 (TWO FAMILY RESIDENCE) and RI (SINGLE
FAMILY RESIDENCE) DISTRICTS.
WHEREAS, A. BENASSI has heretofore filed with the Planning
Commission of the City of Gilroy a petition in due form requesting
the prezoning of a 37.028 acre parcel as C1 (Neighborhood Commercial),
R3 (Low Density Multiple), R2 (Two Family Residence) and RI (Single
Family Residence) Districts; and
WHEREAS, the Planning Commission of the City of Gilroy has given
due notice of a public hearing upon the said application, in accordance
with the Zoning Ordinance of the City of Gilroy, has held the hearing,
has approved a Negative Declaration under the California Environmental
Quality Act, and has made its report to the Council of the City of
Gilroy, in which it recommends that the 37.028 acre parcel hereinafter
described be prezoned as set forth above; and
WHEREAS, the Council of the City of Gilroy has fixed the 3rd day
of January, 1978, at the hour of 8:00 o'clock p.m. in the Council
Chambers in the City Hall at 7390 Rosanna Street, Gilroy, California,
as the time and place for hearing the said report and recommendation
upon the said application, and notice of the said hearing has been
given in accordance with the s.aid Zoning Ordinance, and a public
hearing has now been held upon the said application before the Council
and the Council having duly considered the said application and the
evidence presented, has approved the Negative Declaration under the
California Environmental Quality Act, and has determined that the said
Zoning Ordinance should be amended in accordance with the report of
the said Planning Commission,
NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:

Section 1: The Zoning Ordinance of the City of Gilroy is hereby
amended by prezoning to become effective upon annexation and placing
in Cl, R3, R2 and RI Districts, as the same are described and defined
in the Zoning Ordinance of the City of Gilroy, the following described
premises:
Ail that property located in the County of Santa Clara,
State of California, on the SoUth side of First Street
300 feet east of Santa Theresa Boulevard, identified
as Santa Clara County Assessor's Parcels 808-1-6 and
808-2-1;
To Cl District,ethe most northerly 530 feet
thereof;
To R3 District, the next 370 to 375 foot parcel
south of and adjacent to the C2 zone;
To R2 District, the next 150 foot parcel south of
and adjacent to the R3 zone;
To Ri District, the remaining southerly portion of the
property.
Section 2: The official map constituting a part of the Zoning
Ordinance of the City of Gilroy shall be amended to reflect the fore-
going changes of classification of the said property.
Section 3: All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
Section 4: This ordinance shall take effect and be in full force
thirty (30) days from and after its passage and approval, and upon
annexation of said property to the City of Gilroy.
