ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING
ORDINANCE OF SAID CITY BY PREZONING A 17.32 ACRE
PARCEL ON T~iE NORTHEAST CORNER OF GILMAN ROAD AND
THE SOUTH VALLEY FREEWAY AS IZ (INTERIM ZONE) AND
RIiAFFIRi4ING THE PREZONING OF A 153.3 ACRE PARCEL
ADJOINING THE CITY OF GILROY ON THE SOUTH SIDE OF
LEAVESLEY ROAD EAST OF THE SOUTH VALLEY FREEWAY AS
HC (HIGHWAY COMMERCIAL) AND !Z (INTERIM ZONE).
WHEREAS, FRANK FILIPPI has heretofore filed with the Planning
Commission of the City of Gilroy two petitions in due form
requesting the prezoning of a 153.3 acre parcel as HC (Highway
Commercial) and IZ (Interim Zone) Districts, and of a 17.32 acre
parcel as IZ (Interim Zone) District; and
WHEREAS, the Planning Commission of the City of Gilroy has given
due notice of a public hearing upon the said application, in
accordance with the Zoning Ordinance of the City of Gilroy, has held
the hearing, has approved a Negative Declaration under the California
Environmental Quality Act, and has made its report to the Council
of the City of Gilroy, in which it recommends that the prezoning of
the 153.3 acre parcel hereinafter described be reaffirmed and the
17.32 acre parcel be prezoned as set forth above; and
WHEREAS, the Council of the City of Gilroy has fixed the 5th
day of July, 1978, at the hour of 8:00 o'clock p.m. in the Council
Chambers in the City Hall at 7390 Rosanna Street, Gilroy, California,
as the time and place for hearing the said report and recommendation
upon the said application, and notice of the said hearing has been
given in accordance with the said Zoning Ordinance, and a public
hearing has now been held upon the said application before the
Council, and the Council having duly considered the said application
and the evidence presented, has approved the Negative Declaration
under the California Environmental Quality Act, and has determined

that the said Zoning Ordinance should be amended in accordance with
the report of the said Planning Commission,
NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
Section 1: The Zoning Ordinance of the City of Gilroy is hereby
amended by reaffirming and prezoning to become effective upon
annexation and placing the most northerly 20 acre portion fronting
on Leavesley Road in an HC District and the southerly 133.3 acres,
more or less, plus an additional 17.32 acres fronting on Gilman
Road in an IZ District, as the same are described and defined in the
Zoning Ordinance of the City of Gilroy, the following described
premises:
Ail that property located in the County of Santa
Clara, State of California, described as follows:
Parcel A
To HC District, the most northerly 20 acres of Santa
Clara County Assessor's Parcel No. 841-19-31 east of
the South Valley Freeway and south of Leavesley Road.
Parcel B
To IZ District, that parcel south of and adjacent to
Parcel A and being the remaining portion of Santa
Clara County Assessor's Parcel No. 841-19-31 and all
of Assessor's Parcels Nos. 841-19-16 and 32.
Section 2: The official map constituting a part of the Zoning
Ordinance of the City of Gilroy shall be amended to reflect the
foregoing changes of classification of the said property.
Section 3: Ail ordinances and parts of ordinances in conflict
herewith are hereby repealed.
Section 4: This ordinance shall take effect and be in full
force thirty (30) days from and after its passage and approval,
and upon annexation of said property to the City of Gilroy.
