Minutes 1928/06/06 368 Gilroy, Calif., June 6th, 1928. The regular adjourned meeting of the Common Council of . June 4th, 1928, was oalled to order by His Honor Mayor Jas. Princevalle. Present Councilmen Walter G. Fitzgerald, E. Martin Johnson, C. E. Fredrickson, John A. Clark, Irvin Hollister, Elmer J. Chesbro; Absent, Councilmen, None. Motion by Johnson, seconded by Clark: That Resolution No. l ......~"'..<'''''"''''', --"""""__",-,"-~______",,,,,, -""",-,~,,,,,",,,,~-"~,,,_,,,,,,,_=,,=,,",~~,~~__,",,,,,~,,'~--'.""';~"",='''i,'.' , ~ '<; '~'~'=!4'V~';;iIMU~~==g~:~,<~., ",~\:.",",,"';;;:';=.-1;ii:;;.-;;;:.c..'-"."".-;;4=,,~':"~''':'-,'''i>'',~ 8, 1928, be passed and adopted as follows: 3{)f) WHEREAS, the Mayor and Conunon Council of' the City of Gilroy did in open session publicly open, examine and declare all bids and proposals received f'or street improvement work, as described in the Uesolution of Intention No. 4-1928, of' the Mayor and Corruuon Council of the City of Gilroy, passed on the 11th day of April, 1928, and find the bid of' the Calif'ornia Construction Company, a corporation, to be the lowest, now therefore, be it RESOLVED, that the Mayor and Common Counoil of' the City of Gil- roy does hereby reject all of' said proposals or bids, except the next Herein mentioned, and does her:e1>,~. aw~rdl;the contract for"ao- Jng,the said work and improvement to the lowest regular responsible bidder, to-wit: California Construction Company, a corporation, at 'the price named in its proposal ,or bid, ne it f'urther RESOLVED, that the City Clerk of' the City of Gilroy is hereby di- rected to return to the parties f'iling the same, the bond or check accompanying all of' said proposals or bids rejected, as aforesaid, and to hold the bond accompanying said proposal or bia of the Calif'ornia Construction Company, a corporation, accepted as afore- said, until said contract is duly entered into; be it further RESOINED, that the City Clerk of the City of Gilroy is hereeby directed to post notice of this award conspicuously for five days on or near the Chamber door of the Council Chamber of' said ~fayor and Common Council, and also publish said notice twice in the Gilroy Evening Dispatch, a daily newspaper of' general circulation publi s!led and circulated in said Ci ty, and hereby clesigna ted for tha t purpose by said Mayor and Conullon Council. Vote, Ayes, Walter G. Fitzgerald, (but in voting thus he stated that he objected to the white pavement and the district to be covered) and his object was not to antagonize, E. Martin Johnson, C. E. Fred- rickson, John A. Clark, Irvin Hollister, Elmer J. Chesbro; Noes, Councilmen, None; Absent, Councilmen, None. Motion by B. Martin.Johnson, seconded by C. E. Fredrickson and carried: That resoluti8n fixing compensation of City Engineer be passed and adopted as f'ollows: RESmLVED, hy the ;\layor and Comlllon Council of' the Ci ty of' Gilroy, that the compensation of' the City Engineer of said City f'or all en- gineering services heretof'ore rendered and hereaf'ter to be rendered by him in connection with and incidental to the work to be done and improvement to be made in said City, as said work and improvement are 370 .:;;;;;' X indicated and described in "Resolution .AdoptinG Plan~ and specifi- ~,,"""" cation~, which Resolution was passed and adopted by the Mayor "'.~ and COll@on Council oe said City on the 11th day oe April, 1928, and is hereby referred to and made a part hereof, be and said compensation is hereby :fixed at the SWll which shall be 7 per cent. of the contract price of said work and improvement.
