B;y motion of' Chesbro, seconded by Clark Ordinance No. 353 was passed and adopted after having been read amI re-read by title as f'ollows: , An Ordinaco amemling Section 242 .A of' Article III, of' Chapter IV, of Part II, of the Municipal Code of' the City of' , Gilroy, f'or the purpose of' Building Regulations and providing f'or Building Pennits. Vote, Ayes, Councilmen Fitzgerald, Johnson, Fredrickson, Clark, Hollister, Chesbro; Noes, Councilmen, None; Absent Councilmen, None. By motion of Clark, seconded lJY Chesbro, Orclinance No. 354 was passed and adopted arter having been read and re-read by title as follows: An ordinace amending Sub-division No. 5 of Section 240 of the Municipal Code of the City of Gilroy, relative to the Fire Limits of the City of Gilroy. Vote, Ayes, Councilmen Fitzgerald, Johnson, Fredrickson, Clark, Hollister, Chesbro; Noes, Councilmen, None; Absent Councilmen, None. By motion of' Chesbro, seconell by Clark Ordinance No. 355 was passed and adopted after having been read and re-read by title as follows: An Ordinance regulating tra:rric and care of vehicles upon the public streets of the City or Gilroy, ancl repealing Ordi- nance No. 343 and all Ordinances and parts of Ordinances in conflict herewith. Vote, Ayes, Councilmen Fitzgerald, Johnson, Fredrickson, Clark, Hollister, Chesbro; Noes, Councilmen, None; Ab- sent Councilmen, None. Henry B. Fisher, City Engineer, presented statement on manner of having work done and assessments as made, and the same was ordered placed on file. By motion of Fredricl{son, seconded by Chesbro the following Resolution overruling protests was passed and adopted, as fol- lows: iiHEHEAS, the assessment for street work done under that cer- tain contract dated the 27th day of June, 1928, between the Cali- nia Construction Company, a corporation, first party and George Easton, as Superintendent of streets of the City of Gilroy, second party, for the doing of all street work mentioned and des- cribed in Resolution of Intention No. 4-1928, passed and adopted by the I\Iayor and COEllllon Council of the City of Gilroy on the 11th day of April, 19;~8, and now on file in the office of the Clerk of said City, to which Resolution or Intention reference is here- by made for a description of said work, was filed in the office of the Clerk of said City of Gilroy on the 16th day of Novffiuber, 1928; and WlIEH.EAS, said Clerk did thereupon fix Monday, the 3rd day of 383 December, 1928, at the hour of 8 o'clock, P. M. of' said r~ ~ u ,~ ""- ,"~ 384 day, at the meeting place of' the Mayor and Common Council of' the City of Gilroy, in the Council Chamber in the City Hall in saiel C'i ty, as the time and place of hearing on said assessment, as required by law, and as. the time and place for making written objections thereto, as provided for in the Improvement Act of 1911; and ,;-- WHEREAS, notice of the filing of said assessment and of' the time fixed f'or hearing thereon was duly given by post- ing and publishing, as required by law, as appears f'rom the affidavits of E. F. Rogers, City Clerk, and John N. Hall, now on file in the office of the Clerk of said City of Gilroy; and WHEREAS, said hearing was duly and regularly adjourned by the Mayor and COmlllOn Council of the City of Gilroy f'rom Monday, the 3rd day of December, 1928, at the hour of 8 o'clock, P.M. o~ said day, to Friday, the 7th day of De- cember, 1928, at the hour of 8 o'clock P.H. of said day; and WHEIillAS, certain objections were made against the work perf'ormed under said Resolution of Intention No. 4:-t928 and against the assessment therefor; and WHEREAS, the Mayor and Common Council of said City of Gil- roy did proceed to hear and consider the protests and object- ions, and after having duly considered the same: NOW 'flmREFORE BE IT RESOLVED by the :Mayor and Common Coun- cil of the City of Gilroy that said protests and objections be and the same are hereby o~erruled, and the IJayor and Common does hereby determine that the work performed under said Reso- lution of Intention No.4-1928 was perfor:med according to the plans and specifications and in a good and substantial man- ner, anel said Mayor and Conunon Council does hereby approve 11'7_ said work and all acts and determinations of the Superinten- dent of Streets in relation thereto. AND BE IT FURTHER HESOLVED by the Mayor and COl1ullon Council of said City of Gilroy that the assessment herein mentionecl for street work done under said Resolution of Intention No. 4-1928, hereinbefore ref'errecl to herein, toge.ther with the diagram attached thereto, be and th I b e same are lere y approv- 1 385 ed and aclopted, and the Superintendent of' Streets of said Ci ty of Gilroy is hereby directed to attach a warrant thereto and deliver srone to the contractor, as required by law. Vote, Ayes, Councilmen E. Martin Johnson, C. E. Fredrick- son, Jolm A. Clark, Irvin Hollister, Elmer J. Chesbro; Ex- cused from voting, Walter G. Fitzgerald; Noes, Councilmen, none; Absent Councilmen, None. ~Iotion by Fredrickson, seconded by Clark and carried that building permit be granted I. o. o. F. Lodge. Matter of advertising for furnishing a Ford Truck was lef't with the Chairman of the street Conunittee and the City at- torney.
