May 13, x 1929 ~"1!;~ ,.....' ~ ........, ~- The regular adjourned meeting of the Common Council of May 6th, 1929, was called to order by His Honor Mayor Jas. Princevalle. Present Councilmen: Walter G. Fitzgerald, C. E. Fred- rickson, John A. Clark, Irvin HOllister, Elmer J. Chesbro; Absent Councilman: E. Martin Johnson. Motion by Elmer J. Chesbro, seconded by John A. Clark and carried: That a warrant in the amount of $100.00 be . ordered drawn in favor of John Gurries for ~ight of way a- cross the northerly part of Sub-lot 9a. Motion by John A. Clark, seconded by Irvin Hollister that Resolution No. 1-1929, adopting plans and specifica- tions be adopted as follows: RESOLUTION NO. 1-1929 ADOPTING PLANS AND SPECIFICATIUNS RESOLVED, by the Mayor and Common Council of the City of Gilroy, that the plans and specifications be, and they are hereby approved and adopted, for the fol- lowing work to be done and improvement to be made in the City of Gilroy, to-wit: For a storm sewer to be constructed in Forest Street from Martin Street to Sixth street, in Martin Street from Forest Street to Railroad Alley, in Railroad Street from Martin Street to Bank Alley, in Bank Alley from Railroad Alley to Monterey Street, in Eigleberry Street from Sev- enth Street Southerly to the catch basin now in 325 feet Southerly from the Southerly property line of Seventh Street, in Sixth Street from Church Street to Eigleberry Street, in Fourth Street from Church Street to Eigleberry Street, in rrhird Street from Church Street to Eigleberry street, in Church Street from First to Second Street, in , First st~eet and along the Easterly projecti8n thereof, from Church Street to the slough called Miller Slough with catch basins and with concrete wall and apron, and stub end grates. All of said work to be done to' the grade described in and in accordance with the plans, profiles and specif~- 405 cations prepared by R. W. Fisher, City Surveyor and Engin- eer, and submitted by said Engineer on the 13th day of May, 1929, and said plans, profiles and specifications be and the same are hereby adopted as and for the plans and specifica- tions for doing said work, and are hereby referred to for further particulars. vote: Ayes, Councilmen Walter G. Fredrickson, That Resolution No. 2-1929, be adopted as follows: RESOLUTION NO. 2-1929 ADOPTING MAP OF IMPROVEMENT DISTRICT NO. TWO. WHEREAS, R. 'N. Fisher, City Engineer of the City of Gil- rOY, did, on the 6th day of May, 1929, file with the City Clerk a map or diagram showing the boundary lines of the Dis- trict which is to be benefitted by the improvements set forth in the plans and specifications adopted by the Mayor and Com- mon Council by resolution on the 13th day of May, 1929, reference to said map or diagram being hereby made and the same ~ade a part hereof, is hereby adopted as the boundary lines and descriptions of said Improvement District to be and the same is hereby designated as Improvement District No. Two, and the District to be benefitted by said proposed im- provements. Chesbro, seconded by John A. Clark, That Resolution No. 3-1929, be adopted as follows: RESOLUTION OF INTE~TION No. 3-1929. That all said work to be done according to the plans, profiles and specifications therefor, prepared by R. W. Fish- er, City Engineer of the City of Gilroy, duly and regularly adopted by the Mayor and Common Council on May 13th, 1929, and now on file in the office of the City Clerk of said City, and ~ according to the elevations and lines as shown on said plans, which said plans, profiles and specifications are hereby re- ferred to for the full and detailed description of said pro- posed work and improvement. And the said Mayor and Common Council does hereby deter- mine and declare that the aforesaid work and improvement is of more than local or ordinary public benefit and will affect and benefit the district, the boundary lines, and description of which is shown upon a map or diagram of said District, pre- pared by R. W. Fisher, City Engineer, approved by the Mayor and Common Council and on file in the office of the City Clerk, which said mayor diagram is hereby referred to and made a part hereof, and is hereby declared to be the District benefitted by such work and improvement, and that, therefore, the entire cost and expenses of said work and improvement, save and ex- cept therpfrom the sum of Five Hundred, Sixty-five ($565.00) Dollars, to be paid from the General Pund of the City of Gil- roy, shall be and is hereby made chargeable against, and shall be assessed upon said District, hereafter to be known as Im- provement District Number Two, which District is situated with- in the City of Gilroy, County of Santa Clara, State of California; Excepting, however, from the said area as shown upon the map or diagram thereof as adopted by the Mayor and Common Coun- cil, of all public Streets, lanes and public ways, the same 11 A""'" U t $ / _~...;. 'It.)to .. not to be assessed for any expenses of said work and improve- mente The grade to which said work shall be done shall be such as may be shown on the plans, profiles and specifications there- for, now on file in the office of the City Clerk, reference to which is hereby made for a description of such grade. Notice is hereby given that serial bonds to represent un- paid assessments and bear interest at the rate of seven percent per annum, will be issued hereunder, in the manner provided by the Improvement Bond Act of 1915, and amendments thereto, the last installment of which bonds shall mature ten (10) years from the 2nd day of July next succeeding ten (10) months from their date. Except as hereinabove otherwise provided for the issuance of said serial bonds, all of the herein propOsed work shall be done in pursuance of an Act of the Legislature of the State of California, designated "The Improvement Act of 1911lt, approved April 7th, 1911, and amendments thereto. NOTICE is hereby given that on the 3rd day of June, 1929, at eight o'clock P. M. at the regular meeting place of the Mayor and Common Council, to-wit: In t~e City Hall of said City, any and all persons having any objections to the proposed work and improvement may appear before said Mayor and Common Council and show cause why said proposed improvement should not be carried out in accordance with this resolution. The Clerk of the City of Gilroy shall cause this resolu- tion to be published twice in the ltGilroy Evening Dispatch", a daily newspaper printed, published and circulated in said city of Gilroy, and hereby designated for that purpose, by said Mayor and Common Council of said Oity of Gilroy. The Street Commissioner of said City of Gilroy shall cause to be conspicuously posted along the lines of said contemplated work or improvement and along the lines of all open streets, avenues, lanes, alleys and roads within said district, as here- in adopted and described, notices of the passage of this Reso- lution of Intention in the manner and form required by law.
