'--'-' :::::: 0'-' ~ Q The regular adjourned meeting of the Common Council of March 26th, 1934, was called to order by His Honor IIayor IUmer J. Chesbro. Present Councilmen Geo. Easton, S. D. Heck, Geo. A. Wentz, Geo. C. Milias, Jr. Fred C. Boock; Absent Councilman J. H. Hush. By motion of Councilman Geo. A. Wentz, seconsded by Counci1- man S. D. Heck the following resolution was passed and adopter: CITY OF GILROY -- RES 0 L UTI 0 N ---------- N O. 37 1 DETERMINING THAT THE PUBLIC INTEREST AND PUBLIC NECESSITY DEMAND CERTAIN PUBLIC MUNICIPAL IMPROVEMENTS IN AND FOR THE CITY OF GIL- ROY, THE COST OF WHICH WILL BE TOO GREA'l' TO BE PAID OUT OF THE ORDINARY ANNUAL INCOME AND REVENUE OF SAID CITY, TO-WIT: THE AC- QUISITION, CONSTRUCTION AND COMPLETION OF A ~~IN CA~T IRON PIPE LINE TO REPLACE THE PRESENT STEEL PIPE LINE CONVEYING WATER TO THE CITY OF GILROY AND PROVIDING FOR PROCEEDINGS UNDER THE MUNICI- PAL BOND ACT OF 1901. The Common Council of the City of Gilroy DO RESOLVE as follows: Section l. THAT WHEREAS, the public interest and necessity demand certain public municipal ~provements in and for the City of Gilroy, to-wit: The acquisition, construction and completion of a main cast iron pipe line to replace the present steel pipe line conveying water to the City of Gilroy. That the public interest, necessity, safety and service demand the acquisition, construction and completion of said improvement to ., properly care for the sanitary and health conditions of said City. l WHEREAS, a competent engineer has made a careful estimate of the necessary costs of said improvements for said City and finds th~t the cost of said improvement will be $37,000.00, which said estimate has been submitted to and filed with the Common Council of ~ said City; and, '"~ {-" ,i..A ~- -~ .1, WHEREAS, the said entire sum of $37,000.00 for said improve- ment is too great to be paid out of and from the ordinary annual income and revenue of said City; and~ , . NOW, THEREFORE, the Common Council of the City of Gilroy be- ing the legislative and governing body of said municipality, does hereby find the foregoing recitals of facts are t rue, and does hereby determine that the public interest and necessity demand the acquisition, construction and completion of a main cast iron pipe line to replace the present steel pipe line conveying water to the City of Gilroy; and, IT IS FURTHER FOUND AND DETERMINED, that the sum of $37,000.00 for the acquisition, construction and completion of said improvement is necessary~ and the whole cost thereof is and will be too great to be paid out of the ordinary annual income and revenue of said City; and IT IS FURTHER FOUND AND DETERMINED that of said sum of $37,000.00, it will be necessary to incur a bonded indebtedness of said City in the sum of $29,000.00 for the purpose aforesaid. Said Common Council does hereby further determine that all necessary and proper proceedings be and the same shall be taken and had, as provided by the laws of the state of California for the acquisition, construction and completion of said improvement, and for this purpose to submit the incurring of a bonded indebtedness of said City in the said sum of $29~000.00 for the proposal above- stated, to the qualified voters of said City at a special election . to be called as provided by law. Section 2. The Common Council of the City of Gilroy hereby elects to proceed under and pursuant to an act of the Legislature -2- 270 curring of indebtedness by cities, towns, and municipal corpora- tions for municipal improvements, and regulating the acquisition, construction, or completion thereof." which became a law under L...U - ~ w r"I.'j Cj of the State of California, entitled "An Act authorizing the in- constitutional provision without Governor's approval February 25, 1901 (Stats. 1901. page 27), all of the provisions of which are hereby adopted and this resolution and all proceedings to be taken hereunder shall be passed and taken under and pursuant to and in accordance with said act of the Legislature of the State of Cali- fornia.
