PreBent Oouncilmen George Milias,.Jr.,.Jack Rogers,.J.H.Rush,George Martin,George Mason,Nat Heiner. Absent: Councilman None. Minutes 0 f the megular meeting of December 6,1937 and special meetings of December 8th and December 27th,1937,are read and app- .' roved. Motion by Councilman Mason,seconded by Councilman Rogers and carried that reports of the City officers beaaccepted and placed on file. Motion by Councilman Rush,seeonded by Councilman Rogers and carried that Leon Thomas be appointed Police .Judge for the City 42(3 ,... I" i.._\j ~~:: of Gilroy for the year 1938. The Clerk is now instructed to open bids from the various oil W t~:J Cd companies to furnish the city with gasoline for the ~nsuimg twelve months. Seven bids are opened,and read. Motion by Councilman Rush,seconded by Councilman Mason and carried that the bid of the Union Oil Co.of California to furnish the City with gasoline for the next twelve months be accepted, 111I theirs being the low bid. . .4 Motion by Councilman Milias,seconded by Councilman Heiner and carried that ;$5000.00 be trans ferrec from the \7a ter Fund to the General Fund. Motion by Counc ilman Rush, seconded by Councilman Heiner and carried that the Clerk be instructed to write to the ElectrioAl Products Corporation that the City will purchase from the Elec- trical Products Corporation two double faced signs,8' wide by 4'6" high with 12" letters (Gilroy) and cowboy in neon the same as drawing submitted by the Company December 10,1937,installations to be complete in every detail and turned over to the City ready ... to illaminate,the price and conditions to be the same as stip- ulated in the agreement,dated October l6,1937,between the City and the company,namely $30.00 per month. .,- Motion by Cpuncilman Mason,seconded by Councilman Heiner and carried that the Clerk be inst~ucted to to publish the following Notice to Contractors: NOTICE TO CONTRACTORS Sealed proposals or bids will be received by P. A. Cox, City Clerk of the City of Gilroy, at his office in the City Hall, Gilroy, California, until 5 o'clock p.m. on Friday, the 14th day of Janu- ary, 1938, for the improvement of Leavesley Road by constructing a Box Culvert in the City of Gilroy, in accordance with plans and specifications on file in the office of the City Clerk. ~ J Extra copies of the plans and specifications referred to may be had at the office of the City Engineer at 505 S. Bayview Avenue, Sunnyvale, California, or at the office of the City Clerk of the City of Gilroy, to which bidders are referred for all particulars therein and thereby appearing. 427 "... Each proposal must be accompanied by a check certified by a responsible bank for a sum not less than ten (lO) per cent of the total amount of said bid or proposal, payable to the City of Gilroy, as liquidated damages in case the bidder is awarded the contract, subject to an approval by the Department of Public Works of the State of California, and fails to file, within ten (lO) days after such award, satisfactory bonds as required by law and by the Charter of the City of Gilroy, for the faithful performance of the terms of the contract and for the protection of material men and laborers. '- The attention of bidders is called to the provisions of Article 2, Chapter 1, Part 7, Division 2 of "Labor Code" (Chapter 90 Stat- utes 1937) of the Legislature of California (Prevailing'Wages), and to the Resolution of the Common Council of the City of Gilroy, a- dopted on December 6th, 1937, in compliance therewith, and now on file and open for inspection in the office of the City Clerk in the [ City Hall of said City. The general prevailing rate of per diem wages in this lo- cality for each craft or type of workmen needed to execute the contract for said work and improvement and also the general pre- vailing rate for such legal holiday, Saturday, Sunday and over- time work is as ascertained and set out in said resdUtion, which resolution is by reference made a part of this notice and shall have the same force and effect as though fully set forth herein. Plans and specifications to take away may be had at a cost of Two Dollars ($2.00) per set. A refund of of One Dollar will be made for these sets when returned within ten (10) days after date of award of contract. All proposals or bids must be made upon blanks obtained from the City Engineer, at his office as aforesaid or at the office of the City Clerk at the City Hall. They must be sealed and addressed to the Mayor and Common Council of the City of Gilroy, and must be ~ plainly endorsed: "Proposal for the Improvement of LEAVESLEY ROAD i.....r by Constructing a Box Culvert in the Ci ty of Gilroy.
