Minutes 1938/11/07 463 Gilroy, California. November 7,1938. The regular monthly meeting of the Common Council is called to order by His Honor Mayor S.D.Heck. Present:Councilmen George C.Milias,Jr.,.Jack Rogers ,James Battersby, George A.Martin,George M.Mason,Nat Heiner. Absent:Counci~en None. Minutes of the meetings of October 3,11 and 28,1938 are read and approved. A communication from Logan & Frazer,auditors,is read stating that they had completed the audit of the city's books and records for the quarter .July 1,1938 to September 30,1938 and round everything [. in order. A communication is read from Mr.E.M.Rea relative to improvements to a ditch on the Sewer Farm property. A communi cat ion is read from the Pac ific Telephone and Telegraph Co. relative to the removal of their poles from North Monterey Street. A communication is read from the Califbrnia State Automobile Associat ion re1at ive to ~lac ing STOP signs at tbe several intersect ions on Fifth Street. The Clerk is instructed to order four reflector type STOP signs. Superintendent of Streets C..J.Weppener reports that one-third of of the property owners names appear in the petition to ppen an alley from First Street to Second Street between Rosanna and Hanna Streets. No action is taken. Motion by CouncilmantMilias,seconded by Councilman Rogers amd carried that the Coast Counties Gas & Electric Company be granted a right of way to erect a power pole near the southwest corner of th e Gymkhana Field. The Clerk is instructed to communicate with Mr.R.F.Benson relative to a righ t of way for the Coo st Counties Gas &, Electr ic Company t'o... place three power poles along the east line of the l,l..J.B.Ranch. 464 Reports of the Ponndmaster and the Health Department are read and ordered placed on file. t:v . - -- t:O t:t'j Q. Motion by Councilman Mason,seconded by Councilman Battersby that Resolution No.102 be adopted: RES 0 L UTI 0 N N 0 102 BE IT RESOLVED by the Mayor and Common Council of the City of Gilroy, that said City of Gilroy hereby accepts the conveyance hereto attached and consents to the recordation thereof. Said conveyance having reference to a certain Decree of Distribution made and entered in the Superior Court of the State of California, in and for the County of Santa Clara, in the matter of the Estate of MARY~E. OUSLEY, deceased, and where- in under said Decree of Distribution there was distributed to the City of Gilroy certain real property therein described, and said Decree being dated October 28th, 1938. Passed, approved and adopted this 7th day of November, 1938 at a regular meeting of the Common Council of the City qf Gilroy. Ousley be reimbursed in the sum of $96.39 for County taxes for the years 1936-37,1937-38,1938-39 on the 36.61 acres of land which were devised to the city by her Last riill. :;ouncilman Hogers anLounces that the Sewer Comrnittee will call on Er.S.M.Rea to discuss improvements to the ditch at the Sewer Farm. The Clerk is instructed to ':Jrite to Mrs .Leola Brownell to inform h her that all the $ewer farm land is under l~ase at present and 465 and that the 8ity could not reimburse her for water on the land she has under lease. The Clerk is instructed to vvrite to the City clerks of Los Gatos, Uountain View and Salinas requesting copies of their ordinances relat ive to garbage disposal. The Superintendent of Streets is instructed to call on Mr.R.E.TIood to di scuss with him the removal 0 f trees and vines at the inter- sect ion 0 f Fourth and Hanna Streets. The Cle rk is instructed to draw a warrant in. 'fa vor of the VTagner Transfer to compensate them for placing the flags on Monterey Street Navy Day. It is unanimously decided to have specifications of various makes of trucks presented to the Council. Botion by Councilman Milias,seconded by Councilman Hogers and carriadunanimously that the sum of $1500.00 be transferred from the ~'fater ]'und to thsoGeneral Fund. Councilman Rogers reports a fire hazard on the east side of North ]\;Ionterey Street between Lewis Street and 1. O. O. F . Avenue ,property owned by V.R.McAlpine. The City Marshal is requested to investigate. Reports' pf the CityrOfficers are read. It is unanimously decided that the bill of w~.Sam~Newton for gravel not be allowed on account of lack of authorization. Mot ion by Counc ilman I-leiner, seconded by Counci lman Bat tersby and carried unanimously that bills as presented be allo~ed and warrants ordered drawn on the Treasurer.
