Present: Councilmen: George C.Milias,Jr.,George A.~furtin,George
M.Mason,Nat Heiner. Absent:Councllmenl Jack Rogers,~ames Battersby.
Minutes of meetings of September 7th,15th,19th and October 2nd,
1939 are read and approved.

~IT.J.H.Cramer appears before the Council to discuss the placing
of novelty games,marble games and phonographs,in various business
places in the a;i1;y. and otfers to pay ~p500.00 a year- for the ex-
elusive right to place these machines in the City. Mayor Heck
announces that a committee will be appointed to investigate this
matter.
A petition signed by thirteen persons requesting the Council
make a thorough study and take appropriate action on the unusual
noise,at late hours, which comes from the Glad Tidings Church
located at Sixth and Hanna Streets. Accompanying this IE tit ion
is aletter,signed by Dr.Hugo Schmitt,stating that Ivlrs.Pasquale
Perrelli,who resides at 17 North Hanna Street,is ill and highly
sensitive to noises and unnecessary excitement.
Motion by Councilman Milias,seconded by Councilman Mason and
carried unanimously that the li~yor instruct the City Attorney
to have the officials of the Glad Tidings Church appear at his
office to discuss the matter of the disturbing noises complained
of.
Councilman Heiner announces that the annual Firemen's banquet
~ will be held Monday evening,October 16th at Hotel Milias.
Mayor Heck di scusses a plan offered to make a complete 1ns1.lr'Ql.nce
survey of city buildings the work to be done at no expense to the
city. No objection being made the Mayor states instructions will
be given to conduct the proposed survey.
Mr.A.R.Dyer,chairman of the Fire Prevention Week Committee of the
Junior Chamber of Commerce,appears before the Council to discuss
a clean-up of various fire hazards throughout the city and presents
several photpgraphs showing conditions ~n various parts of the City.
Mayor Heck appoints the Superintendent of Streets to make an
inspection of all prope,rties for fire hazards and report to the Fire
COIllmi ttee the names of'ownersanci tenants of properties where fire
hazards exist.
Mayor Heck signs a Fire Pre'Ctention Week proclamation presented

by the Junior Chamber of Commerce.
A petition signed by eighteen residents on behalf of the Retirement
Life Payments Act requesting permission to distribute literature
to the houses and open cars on the street until after election.
Permission is given to deliver literature "rectly to householders.

Counc ilman I,lason presents the plan for the proposed water main
extension in the northwest section of the City and estimates the
cost at $3l22.77.
Mayor Heck announces a meeting 0 f the Counc il will be called bei'ore
October 20th to discuss the plan and to take advantage of the 30 day
price quotation made by the D.S.Pipe and Foundry Co.
Application of J.M.Silva for the position of Janitor for the City
Hall building is II' esented. No act ion is taken.
Councilman Heiner presents the proposed tentative specifications
for a new fire truck.
A conmmnication is read from Llr .Louis Normandin protesting against
the extra charGes made to redeem his property which had been del-
inquent for more than five years. The Clerk is instructed to viri te
Mr.Normandin stating that no refund could be made on penalties
charged due to fact that accrued costs to the city amounted to more
t han ~)lO. 00.
Mayor Heck states that he will instruct Ia.Ed.Piedrnont to call at ,
tIE City Attorney's office and present his evidence that Mr.Sam
Newton is hauling his own garbage ~ontrary to Ordinances NO$.428,
429 and 430,City of Gilroy. Mayor Heck instructs the City
Attorney to proceed against 1~.Newton upon presentation of proper
evidence.
The City Attorney reports that Gordon Chappell has agreed to
open the ground around the gasoline tank he installed,recently,
for the purpose of inspection and to secure a permit for placing
the tank.
The City Engineer reports the Fi rst E3treet sewer extension prac-
tically completed and that the state Highway engineers have agreed
to his plans for the First Street realignment. The placing 01' valleys
at several intersections along Monterey Street on a day labor basis
'will be presented to the State Highvlay department for their approval.
The question, of the city's water rights on the Uvas Creek with
reference to an application for appropriation of water by the
~~outh ~3anta Clara Valley '!iater Conservation District is referred
to the City Engineer and the City Attorney for investigation.
Motion by Councilman Milias,seconded by Councilman Martin and
carried unarlimously that the sum of :i?3000.00 be transferred from
the Water Fund to the General :Fund.

Reports of city officers are presented and read.

Councilman Mason repoets on a request from Mrs.J.M.Radin for
additional pipe line extensions on Fourtb Street,outside the
ci ty limits ,~ll costs for material and labor to be paid by the
.roperty owner. '
The Clerk is instructed to advertise for bids for 2286 feet of
8 inch cast iron pipe-18 foot lengths.
Motion by Counc ilman Milias ,sec onded by Councilman Martin and
carried unanimously that bills as presented be allowed and
warrants ordered drawn on the Treasurer.
