This regular monthly meeting of the Common Council is oal1ed to order by His Honor Mayor George C.Milias,Jr. Present:Councilmen George M.Mason,James Battersby,Nat He~ner, J.H.Wentworth. Absent:Coun01lmen George A.Mar.iD,Jaok Rogers. Minutes of the meetings of Deoember 2nd and 17th,1940, are read and approved. This being the time speoified in letters sent to ten laeeligasoline dealers asking for bids to turn1.h the oity wi~h gasoline for a twelve months period, January 15,1941 to January 14,1942, the following bids are received and rea4: Standard Oil Company of California, Shell Oil Company,Inc..Seaside Oil Company, Tide Water Assooiated Oil Company,Gilmore Oil Company. The Texas Company. Riohfield Oil Corporation. MOtion by Counoilman Wentworth, seoonded by Counoilman Heiner and carried that the gasoline business for the ensuing twelve months be divided between the Shell Oil Company.Ino.,Stamard Oil Company of California and the Seaside Oil Company.t tll02~ per gallon. Mr.Kirby MoAtee ,manager of the Gil1"oy Telephone Company, now appears before the Counoil and presents an application tor a franchise tor the Gilroy Telephone Company tor a period of twenty-five years. The applioation for franchise tran. the Gilroy Telephone Company is read by the City Clerk. RESOLUTION NO. 129 is presented and read. Motion by Councilman Battersby, seoonded by Counoilman Bainer that w RESOLUTION NO.129 be adopted. r--- 596 RESOLUTION NO. lIt BE IT RESOLVED, by the Mayor and Common Council of the City of Gilroy, THAT WHEREAS an application for a telephone and telegraph franchise has been filed with the Common Council of this City by the Gilroy Telephone Company, and this Body proposes to grant a franchise for .that purpose, IT IS HEREBY ORDERED, that the fact of said application shall be advertised and bids for said franchise invited in the manner and for the time required by law. That the time for the receiving of such bids shall be up to 5 o'clock, P. M. of the 17th day of February, 1941. Said notice to be publiShed in the Gilroy Evening Dispatch for ten (10) suc- cessive days, or as often during said period as said paper is published, the full publication to be completed not less than twenty (20) days before the 17th day of February, 1941. The Mayor anDounces that work on Miller Slough will oontinue when- ever the ground dries sufficiently for the shovel to operate. I I - I ! I I I 597 The Clerk is instruoted to write to the Southern Pacific Company calling their attention to a previous letter from the city with ref- erenoe to the condition of several crossings in the oity and to ascertain what the company intends to do to remedy the situation. The Clerk is instructed to send an Enoroaohment Permit to the Division of Highways asking that pea.alBian crosswalks be painted on Old Gilroy street at the Maple Street and Chestnut Street inter- seotions and that permission be granted to place Division of High- way approved Sohool Crossing signs at both of these intersections. The Mayor announoes that all sidewalks in the oity will be in- speoted by the Superintendent ot Streets and a report of hi8~t~nding. will,be_made to the Council. The Mayor states that Miss.Edith Hornbeck has nade a request to' place a mail. box on oity property on North Monterey Street. This matter is referred to the Water Superintendent. Motion by Counoilman Mason, seconded by Counoilman Wentworth and carried that the sum of $200.00 be transferred trom the General Fund to the Library Fund. The Mayor discusses the prevalanoe of mistletoe in trees on private property and the danger of infeotion ID trees in park ways fram this condition. This matter is reterred to the Forestry Board for in- vestigation and report. Motion by Counoilman Mason, seoonded by Councilman Heiner and carried that the sum of $40.14 be transferred from the General Fund to the 1905 Munic ipal BonA Fund. Counoilman Heiner discusses the location of a tire plug at MOnterey and Old Gilroy Street. The Water Committee is instructed to proceed with the installation of a fire plug,in a location to be .elected by them, at Monterey and Old Gilroy Streets. Motion by Councilman Battersby, seconded by Counoilman Heiner and carried that t50.00 additional be added to the Petty Cash Fund of the Water Department. The chairman of the Stteet Connnittee and the Superintement of streets are requested by the Mayor to investigate a stonn water oondition at the oorner of Old Gilroy am Chestnut streets. A oommunication is read from Postmaster R.M.Martin thanking the Council for the use of spaoe in the Clerk's offioe during alien reg istration. Reports of the City officers are read. 598 Motion by Councilman BattersPy,seconded by Councilman Wentworth and carried that the reports of the city offioers be acoepted as read and plaoed on file. Motion by Counoilman Heiner,secoDded by Counoilman Mason and oarried that the bills as pResented be allowed and warrants ordered drawn on the Treasurer.
