This regular adjourned meeting of the Common Council is oalled to
order by His Honor Mayor George C.Milias,Jr.
Present:Counoilmen:George M.Mason,Jack Rogers,James Battersby,
Nat Heiner,J.H.Wentworth. Absent:Councilmen: George A.Martin.
Motion by Councilman Rogers, seoonded by Councilman Battersby and
carried that the bill of the Gilroy Publishing Company in the amount
of $118.25,tor publishing a Notice of Application for Telephone and
Telegraph Franchise and Inviting Bids for Same, be allowed.
This being the time speoified in a public notioe calling for bids
for the te;Lephone and telegraph franchise for the ensuing twenty-five
years, one bid 1s presented and read:
Gilroy Telephone Company-bid $118.25.
A communioation from the Gilroy Telephone Company is read, said
cownunioation setting forth the priveleges the company would grant
the city in the event the company was the successful bidder.
ORDINANCE NO.433 is presented and read.

POSES, IN, UPON AND UNDER THE STREETS, ALLEYS, AVENUES, THROUG.
FARES AND PUBLIC HIGHV1AYS, IN THE CITY OF GILROY, STATE OF CALIF-
ORNIA, AND TO EXERCISE THE PRIVELEGE OF OPERATmG TELEPHONE AND
TELEGRAPH INSTRUMENTS AND OF DOlm A TELEHONE AND TELEGRAPH BUS-
INESS WITHIN SAID' CITY OF GILROY.
Motion by Councilman'Ue1Der, seoonded by Councilman Wentworth that
the telephone and telegraph franohise be granted to Gilroy Telephone
Company, that Gilroy. ~elephone Company bid of $ll8.25 be acoepted and
that ORDlNANCE;Ne.433 be adopted.

RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF GILROY APPROVING FIRST SUPPLEMENTAL MEMORANDUM
OF AGREEMENT FOR EXPENDITURE OF 1/4 CENT GAS TAX ALLO-
CATED FOR STATE HIGHWAYS.

WHEREAS, the state of California, through its Depart-
ment of Public Works, Division of Highways, haspresented
a first supplemental memorandum of agreement in accord-
ance with a project statement submitted to the City for
expenditure of the 1/4 cent gas tax for the 1939-41 bie-
nnium allocated for State highways in the City of Gilroy;
and

VffiEREAS, the City Council has heard read said agree-
ment in full and is familiar with the oontents thereof;
THEREFORE, be it resolved by the eity oounoil of the
City of Gilroy that said agreement for expenditure of the
1/4 oent gas tax allocated for State highways be and the
same is hereby approved and tm Mayor and the City Clerk
are direoted to sign the same on behalf of said city.
Approved and adopted this 17th day of February, 1941,
at a regular adjourned meeting of the Common Counoil of
the City of Gilroy.

The Mayor reports a slight washout on the carnadero levee
during the reeent severe storms and states that repairs have
been made.
CounCilman Rogers reports that it will be necessary to set
a pole for the street lite on South Forest Street near the
intersection of East Seventh Street. The matter of placing the
light is placed in the hands of the Lighting Committee with power

to act.
Councilman Rogers discusses a request made by A.Mangano,Leaves-
ley Road, to oonnect with the city sewer line. No objection is
made to granting permission to Ilr.Mangano to lay his own sewer line
to connect with the city's sewer i1ne.
City Engineer W.J.Hanna reports that he has turned over his figures
on the cost of straightening the slough ohannel to the Filice and
Perrelli Canning Company management.
