Minutes 1941/05/05 1 608 Gilroy, California. May 5,1941. This regular monthly meeting of the Common Counoil is called to order by His Honor Mayor George C.Milias,Jr. Present;Councilmen:George M.Mason,Jack Rogers,James Battersby, J.H.Wentworth. Absent: Council~en:George A.Martin,Nat Heiner. hlinut es of the meeting of April 7th were read and approved. A co~rmnication is read from the Southern Pacific Company, relative to grade crossings within the cityy the letter stating that approval of the work the company did was made in 1937 by the City Engineer. The Clerk is instructed to search the minutes of 1937 to ascertain if the Council had ever received a report from the City Engineer approving the work done. A cont,:..unication from the League for Local Liquor Control is presented. The Clerk is instructed to oornmunicate with the League of California Cities with reference to the initiative measure endorsed by the League for local Liquor Control. A communication, addressed to the City Attorney, from the San Jose Abstract & Title Insurance Company with referenoe to the sale of tax deeded lands, is read. The City Attorney states that he is waiting for a decision from the title company in this matter. A petition for the opening of an alley from 7th street to 8th Street, between Eigleberry and Church streets is presented,this petition having been re!circulated , the original presentation having been made in leb.1939. Original signers of this petition all ini tialedltheir previous signature, except one party and two additional names had eeen added, making a total of 18 in all. The City Attorney advises that a form letter be drawn up to be signed by each property owner affected by the proposed opening of this alley, each owner stating the number of feet he or she will 60n give. It is unanimously decided that the alley should be of the same width as it now is at the Seventh Street end and the City Emgineer is instructed to cheok this width. I~.Romeo Paganucci volunteers to circulate the letters for signat~re by the property owhers effected. The Mayor now d!eouBses the subject of relief officers for the Police Department. The application of Chris E.Maze for the position of relief officer is presented and read. Motion by Councilman Rogers, seconded by Councilman Mason and carried that Edward Hanna be appointed Relief Police Officer, the Council to make the appointment of an additional relief officer at a later date. Motion by Councilman Battersby,seconded by Councilman Rogers amd carried that Emil Zamzow be appointed Relief Police Officer during the vacation period of Officer Richard Brem,Jr. Motion by Councilman Rogers, seconded by Councilman Wentworth and carried that the salary of the caretaker at the Golf Course be raised to $75.00 per month and that the Gfh1roy Golf and country Club pay the city the sum of $25.00 per month for the rent of the grounds, the arrangement to become effective as of May 1,1941. The Mayor now discusses the Auditorium Building Fund stating that several necessary items had been added to the building and grounds that were not originally anticipated. Mot ion by Councilman Battersby, s ec onded by Counci lman Rogers and carried that the sum of $183.45 be transferred from the General Fund to the Auditorium Building Fund. The matter of the boundaries of the Old Septic Tank property is discussed and the City Engineer is instructed to inquire into this matter. A Memorandum of Agreement for Expenditure of 1/4 Cent Gas Tax for - State Highways is presented and read. RESOLUTION NO.131 is presented and read. Mot ion by Counc ilman Mason, seconded by Counci lman Rogers that RESOLUTION NO.131 be adopted. 610 1 RESOLUTION NO. l31 RESOLUT ION OF THE COMMON COUNCIL OF THE CITY OF GILROY APPROVING MEMORANDUM OF AGREEMENT FOR EXPENDITURE OF 1/4 CENT GAS TAX ALLOCATED FOR STATE HIGHWAYS. WHEREAS, the state of California, through its Depart. ~ artment of Public Works, Division of Highways, has presented ~ a memorandum of agreement in accordance with a project state- ment submitted by the City for expenditure of the 1/4 cent gas tax for the 1941-43 biennium allocated for State High- ways in the city of Gilroy; and WHEREAS, the Common Council has heard read said agreement in full and is familiar with the contents thereof; THEREFORE, be it resolved by the Common Council of the City of Gilroy that said agreement for the expenditure of the 1/4 cent gas tax allocated for State Highways be and the same is hereby approved and the Mayor and the City Clerk are directed to sign the same on behalf of said City. The matter of oiling the streets is discussed and the street Committee is instructed to make a survey and report to the Council. ~ The City Engineer reports on the widening of Monterey street - between the North City Limits and Leavesley Road and that ~~.A. Gurries has offered to donate a twenty foot strip of land on Welburn Avenue for the purpose of widening this street. Mr.E.J.Fabbri, chairraan of the Recreation COmDlission now appears te fore the Council to ask for the city's annual donation of ~325.00 611 to assist the commission in conducting the 1941 program. Motion by Councilman Battersby, seconded by Councilman Mason and carried that the sum of $325.00 be donated to the Gilroy Hecreation Commission for their 1941 progr~a. Mr.Will Bettencourt, representing Victoria Council,I.D.E.S. now ap:r;aars before the Council to ask permission to hold street parades, dances, a fire works display and to close :E'orest Street the length of th"r property, on June 21st and 22nd. I;Iotion by Councilman Rogers, seconded by Councilman Battersby and carried that Victoria Council,I.D.E.S. be granted permission jo hold and dances, street paradesJ to have a fireworks display, the bond for this to be checked by the City Attorney and the Fire Chief,to close Fmrest Street the length of the I.D.E.S. property and to have~a reasonable sized carnival, a report on this item to be given to the Council, for their annual celebration,June 21st and 22nd. Councilman Mason discusses the sign "Coyote Lake Resort",that has been placed re ar the i nte resection of Monterey Street and Leave sley Road. The Clerk is instructed to coramunicate with 1~.Henry Eckstrom, owner of the sign, and ask that he remove the sign, as no permit was obtained to erect it and, further, that the projected street widening will make it necessary to remove all signs located in this secti on. Renorts of City Officers are presented and read. Ihotidn by Councilman Wentworth, seconded by Councilman Rogers and carried that the reports of the City officers be aooepted as read ani placed on file. Councilman Mason discusses the ohange that will have to be made in tre pipe line on North Monterey Street when the projected widening work is done. Councilman Mason is instructed to present plans, specifications and oosts to the council. The Mayor liscusses city finances and the reoommendation by Logan & Frazier, city auditors, that the city purchase some of its paving bonds with the money in the inactive bank account. The Clerk is in- struoted to ascertain the amount of paving bonds remaining unpaid. Motion by Councilman Battersby, seconded by Counctlman Rogers aDd2 612 ca~ried that bills as presented be allowed and warrants ordered drawn on the Treasurer.
