This regular monthly meeting of the Common Council is called to
order by His Honor Mayor George C.Milias,Jr.
Present:Councilmen George A.1Aartin,George M.Mason,Jack Rogers,
J.H.Wentworth. Absent:Councilmen James Battersby,Nat Heiner.
Minutes of the meetings of October 6th, 13th and 20th,194l, are
read and approved.
A co~nunication is read from the Gilroy city Planning Commission
stating that they had granted Byers Brothers a use permit to erect
a building tor the repair of automobile bodies and general storage
on property owned by them and being a portion of Lot 3,Block 4
North,Range 1 West, City of Gilroy.
A co~nunication in the form af a petition, signed by 1~ry G.
Naughton,B.S.Fredrickson and A.Mainero, asking the Council to with-
hold action on the ratifying of a provis ional for use pe rmi t granted
to Byers Brothers by the Gilroy City Planning Commission, October
29,1941, is -presented and read.
A communication is read from Logan and Frazer stating that they
had completed the audit of the citys books to the period ending
September 30th and had found everything in order.
1~.Ed.Naughton now appears before the Council to discuss the
granting of 30 days, for property owners protesting against the grant-
ing of a use permit to Byers Brothers, to obtain counsel and present,
their side of the case.
A resolution from the Board of Supervisors of Santa Clara County
stating that the Industrial Farm at Madrone Springs would be ppened
November 1,1941, is presented and read.
~~.Ed.Naughton appears before the Council to discuss the petition
presented by property owners in Block 4 North,Range 1 West,protesting
against the granting of a use permit to Byers Brothers.
It is unanimously agreed that ..Jhea:ring of property owners, for and
against the granting af a use permit to Byers Brothers, be held 30
days from the date of the granting of the use permit by the Gilroy
City Planning Commission, October 29,1941, and the Clerk is instruc-
ted to Motify Byers Brothers,by registered mail, that the petition
against the use permit had been presented, that the hearing would
be held 30 days from October 29,1941 and that they be requested not
to proceed with the erection of the proposed building until the
hearing had been held.

Reports of the city officers are presented and read.
Motion by Councilman Rogers, seconded by Councilman Martin and
carried that the reports be accepted as read and placed on file.
City Engineer W.J.Hanna now presents plans and estimates for the
improving the storm water drainage problem on North Forest street.
It is unanimously agreed that this matter of the drainage of storm
water on North Forest street be discussed with the Gilroy High School
Board of Trustees at a meeting to be called by them.
The Clerk is instructed to write to I~.L.Karstedt, Watsonville,Calif.
and ask him to summit his figures on the cost of contemplated work to
be done at the Sewer Farm.
Motion by Councilman Rogers, seconded by Councilman 1~son taa4 oarried
that George C.Benz, contractor, be paid the balance due him,for his
work on the widening of North Monterey Street (Project 7), from the
General Fund the General Fund to be reimbursed for all amounts paid
out of it fcr;}thls wo:rk.~ aaasoon as the Gas Tax money is received from
state of California.
The Mayor states that the Traffic Officer has been instructed to
conduct a campaign tg:::, stop the. tast dri vlng~Qf:7a.:L tomobiles within the
city.
The Traffic Officer is instructed to stop bieY9:leriders,frOm. riding
double and the playing ot football on the side streets.
Couno ilman Rogers recommends that a space of 100 feet , on}'the:1East
side of North Monterey street,noth and south of Leavesley Road,be
marked off as a No Parking area. The Street Cornmittee is instructed
to place the proper marking on the curbing.
Motion by Councilman Rogers, seconded by Councilman Martin and
carried that% bills as fresented be allowed and warrants ordered
drawn on the sTreasurer.
